Can a company override the 7 day internet return law

Following on from my previous post (Help!! I'm getting conned left, right and centre by Aria), I just spoke to the head of customer services at Aria, who told me his company are entitled to charge 10% on all returns, regardless of any law, and that there is norhing I can do about it. That was his actual words. On top of that he told me I deserved to lose the £46. I'm furious, I've never been treated like this off a company before. How can they get away with that?

I'm sorry i haven't read your previous post but i though this may help http://www.tradingstandards.gov.uk/ I'm sorry if you already have it. I hope you manage to sort things out. They have a chat forum on trading standards where you can post a question such as this and someone will help you. good luck0 -

Perhaps a nice friendly recorded letter to the customer services informing them of the law. If they wont take the goods back under the 7 days cooling off period as Distance selling act, you will unfortunately have no option but to inform Trading Standards and seek redress at the Small Claims Court, assuming you have informed them before the 7 Days.
It isn't expensive to go to court, a little time consuming perhaps. I am at present taking Ebuyer to court.

Looks like it's the small claims court for me. A lot of these internet only companies ain't worth the hassle anymore. Some of them try and ripp you off all over the place. The guy from Aria was a complete clown who thinks he can treat me like muck because I live in a different city. He has stolen over £45 from me. I want it back. That's theft, and where I come from you have every right to take your money back one way or another.Titch0

Most companies will back down when they know you have a case and or know you mean business.
Many years ago I ordered a Gforce 3 TI video card from Aria (cant remember the exact model now) They sent me a cheap (not as fast) version of the card. I phoned them up informing them that I paid X amount and that they were in breach of a contract to not supply me this card that I ordered. They wont budge so I sent a recorded letter. A few days later got a call, then told me that they cannot supply the card any more but will supply a slightly better model, which I got. Only just thrown it out now as it wont boot up.
