12 month contract with 6 month break clause?

Hi there

I'm looking at renting a flat which has a 12 month contract with a 6 month break clause in it. The LA has informed me that I could give a months notice at month 5 and therefore leave at month 6. They have also informed me that I provide a months notice at any point after month 6 and leave. Does this sound right?

  • Yes, this does sound right but YOU NEED TO READ THE TENANCY AGREEMENT and ensure that you understand this clause, as they can vary.

    Some say you cannot rely on the break-clause until after the six months have elapsed, and some not.

    So basically it is a 6 month fixed term drafted in way designed to extract a 12 month commission from the landlord...

    Sorry, I don't understand the last sentence. I understand I can't break the contract until 6 months into it.

    So how does the commission work from the landlord?

    Some Break Clauses allow you to give notice at the 6 month point ie to leave a month (or more likely two months) later.

    Some allow you to leave at the 6 month point, having given notice 1 or 2 months earlier (ie at month 4 or 5).

    Some allow the break only at 6 months, some allow it at any time after 6 months.

    read the tenancy agreement to find out. Do not rely on the LL or agent saying something vague.....
  • If you like the property it would be worth while asking for a new contract in say month 5 so that the tenancy doesn't turn in to a periodic one in month 6 which wouldn't give you much stability in the property with the possibility of you just receiving one months notice to vacate.
