Buying a Mini Advice

My son is/was buying a Mini from a garage, when he took it for a test drive he noticed that the sunroof was not working, the garage said that he could either get the job done or they would do it, he told them to do it, laid a deposit down.

They contacted him and told him that the motor they ordered was the wrong motor and they would now reorder the right one.

Today he rung up and asked what was happening, the garage told him that the motor was not the problem as they thought and think it may be the runners but they are not willing to do the work on it, and that my son would need to have the work done himself, and they would consider knocking off some money.

My son has ask them if they could return his deposit and that he does not wish to buy the car.

The salesman has said he would need to talk to his boss.

I just want to know if my son is within his rights to ask for the deposit back. (this is just in case they come back and say no they will not give it back as he is backing out of the sale)

  • they broke the terms of contract when laying the deposit they agreed to repair it, they shouldn't put the burden of the fault on the customer.


    if it were just the runners, then why can they do it? surely the only reason I can think of is that it will cost more than their profit margin to fix it.

    Quite right. There is no shortage of them so no need to buy a broken one.

    Sounds like they've realised its a big job and dont want to foot the bill.

    Insist on a refund - though i think they'll go for "offering money off" as a gesture.

    I'd run a mile - theres no shortage of MINIs and if they are that reluctant to spend money on repairs before you buy the car, imagine how reluctant they'll be if / when something goes wrong after purchase.
  • we owed a mini for 6 years . good thing is there are plenty of second hand parts for them at a very cheap price ..4 seats we bought last time on ebay for 60 quid etc


    bad thing is any little thing that you ll have to go to bmw will set you back quite a bit of money . common issues ie gear too stiff, heating, car seat getting stuck .. check them out properly heating around 500 to sort and we had it again broken this year before we sold it
