Meadowhall disabled parking

Hi, I am writing on behalf of my partner.

He parked at Meadowhall in a disabled bay, neither of us have a blue badge, nor are we disabled. We did this because we was nipping to Argos which is right at the front to pick something up and it was packed - right after Christmas. We realise that he shouldn't have done this, it was a one off and was less than 10 min.

He got issued with a PCN by Parking Control Management, after much consideration and looking on websites about this company, he decided to rip up the PCN that came in the bag which was stuck to his wiper. 28 days passed and today a letter came from PCM ordering him to pay £95 due to 'not displaying a blue badge correctly etc'.. Both of us have read around and realised that the company haven't made a loss from him parking in a blue bay as Meadowhall is free and to be fair, the sign isn't at a reading level - you have to be 7ft to read the sign. So I have decided to appeal, I have wrote a letter to PCM and I want proof that they will have a loss due to us parking there etc etc. Until we get this legal documented proof, we are not paying it.

We shouldn't have parked in the bay, however there is no difference between parking in a non-disabled bay and a disabled pay as there is no charge for either. I will put up what I get back from them.

    then stop ignoring these parking charge notices or you may end up in court explaining to a judge !

    I have asked a board guide to split this into its own thread too

    as for parking in a blue badge disabled bay, they have to lawfully provide those for BB holders under the EA2010 act and you have no lawful right to park in those bays, its people who do this that make it bad for those who can lawfully park there

  • Put a soft appeal in as registered keeper. You can use a format below...

    Dear xxxxx


    As the registered keeper of (reg) I'm in receipt of your parking invoice xxxxxx dated xxxxxx. I wish to invoke your appeals process as all liability to your company is denied on the following:


    1) The amount being claimed is not a genuine pre-estimate of loss to your company or the landowner


    2) Your signage does not comply with the BPA Code of Practice


    3) You are not the landowner and do not have the capacity to offer contracts or to bring a claim



    These points and others will be raised with POPLA should you not accept this appeal, and you will be expected to provide a full breakdown of your alleged loss, and your full unredacted contract with the landowner.


    Any communication that does not either confirm cancellation or include a POPLA verification code shall be reported to the BPA as a breach of their Code of Practice - the BPA recently issued guidance to all members to remind them of this fact. Such communication may also be deemed harassment and pursued accordingly.

    They will reject your appeal, then you will be provided with a POPLA code. The standard appeal, no authority, no GPEOL will see the charge cancelled.

    You can then make a goodwill donation to a disabled persons charity. That way a genuine disabled person will gain some benefit from your parking silliness, not a money grabbing parking company.
