HELP 1 day old car ( to me ) not driving properly can i ask for money back

Hi

Just wondering if anyone can shed any light on my dilema, I have just bought a picanto 07 with only 29,000 on the clock with FSH yesterday from a small dealer in sheffield and i have just driven it to work this evening and its not driving correctly there seems to be a problem with it, it is juddery and slow when you change gears and seems to "lose" power when changing gears rev councter not going above 2. I am now in a mad panic that there is something seriously wrong with it, after googleing it it seems thaere may be a known crank shaft problem, i traded my old car in for £500 and paid £2500 for the new one. Thye gave me a standard 30 day warranty on it but im not sure that this type of problem is covered, can i ask for my money and money for part exchange back or will i lose everything. Im so worried as ive just started an IVA and my mother bought me the car as a gift as mine was old and i needed something more relaible and now am really concerned that ive been sold a dud.

What are my statutory rights etc.... any help much appreciated

    Did you not test drive it before handing over the money?

    You paid £2500 + a £500 trade in? OUCH... You can get 20009 cars for that.

    Take it back to them and see what they say. If your quick they may still have your old car and may refund you.
    But it maybe a simple quick repair.

    Jetwashed the engine to clean it and got water in the electrics.

    Sounds like its in limp mode. Are any lights on?

    A young car with low mileage you wont be deemed to have 'accepted' it yet so they'd struggle not to be required by law to refund you. But open up a dialogue with them

    I agree, but just a check...
    Put the car in neutral, start the engine and press the accelerator. See if you can get the car over 2,000rpm. You can take your foot off the accelerator if you can get it above 3,000.

    These cars arent particularyl reknowned for major problems.

    You could reject the car and get a full refund - and your previous car back if its still available - but if you are otherwise happy with the car which i assume you are if you bought it in the first place - then the dealer will rectify the problem for you. It could be as simple as a faulty coil, air flow meter, o2 sensor, faulty plug, etc, etc.

    The dealer is wholly obliged to sort this out to your satisfaction, so dont be worrying. Let us know how you get on.

    Nonsense, a warranty isn't a legal requirement for any purchase. You clearly misunderstand the Sales of Goods Act
