Giving notice on tenancy, can you give more than one month?

HI all, we are currently renting & we are in a statutory periodic tenancy with one months notice. We are renovating our house & want everything done before moving in. My question is although it is customary to give one month's notice on or around your rental date is it ok to give say 1.5 month's notice? That way we give ourselves enough time to get everything done. I just think one month is not enough but two is too much & will save a bit on rent.

    The bit of that post that's probably most relevant to you is:
    A tenant can end a SPT by giving the landlord at least one months Notice ending on either the last or 1st day of a Tenancy Period (see Crate v Miller 1947). It should be in writing & sent to the address "for the serving of notices" on the landlord.

    If rent is paid monthly/weekly, then the Tenancy Periods run monthly/weekly starting the day after the FT ended.


    Example:

    A 6 month FT tenancy starts on 24th June. It therefore ends on 23rd December. Rent is paid monthly. If a SPT then continues, the Tenancy Periods run monthly from 24th to 23rd of each month. The tenant’s Notice must therefore end on the 23rd (or 24th) of the month.

    If the tenant serves notice on 22nd March, then the notice expires on 23rd April (a full month ending on the last day of the Period). But if the tenant gave notice two days later, on 25th March, the notice would expire on 23rd May - a month later (since 23rd April is less than a month).

    Your notice can't just end on any old day, as G_M explains. Depending on when in the month you give it, "one months notice" might be almost two months later.

    So, yes, it's very common to effectively give six weeks notice - but that doesn't necessarily save you any rent!

    Basically u owe rent for the full month for any part of a month that u reside there. So whilst u can give more than one months notice, u will need to pay until the end if the month u are there ( month in this sense is ur rental period, not necessarily calendar month)

    U can negotiate to be out abit earlier in exchange for accommodating viewings

    You can give 6 months notice if you choose!

    Provided
    a) the notice expires on the correct date and
    b) is at least one month and
    c) it is clear which date your notice is to expire

    it will be valid
  • Your landlord might be happy to accept a part-month's rent. Most especially if you agree to be totally flexible about viewings etcetera and they can get someone else in before your rental-period expires. Most people are willing to be reasonable if you prove that you are.
