Paid a deposit on a car

    Its a well known car - I have been speaking to the guy who he sold it to and the pictures / history etc were correct - its a beauty.


    My question is not about the car but is he allowed to renage on our agreement - someone has told me that it is a legally binging contract and I have the right to buy a same spec car / age etc and he has to stump up for the difference if it costs me more - just want to know if it is worth me pursuing this - any one with any legal knowledge?

    It's all good and well somebody saying, sometimes you have to filter through the BS, look at it another way, if in that month the vehicle got damaged and poorly repaired, would you still feel the obligation to complete the purchase after you have left your deposit?
    If the chap hasn't got the car to sell to you any longer and you get your deposot back, then it is something to possibly just pt down to life's experiences.
  • You could seek legal advice. I though some solicitors offer free initial consultations - might be worth ringing around. Even the threat of legal action may be enough to get them to give the deposit back. Surely the Facebook messages can be used as some kind of proof as they are concurrent so even though you said 'I'll take it' in one message then you can show that on previous messages you were talking about the car. Sorry I'm no expert but thats my thoughts anyway. I think its awful what they have done and hope you get it sorted soon.
