SF.. Grant overpayment.. ADG

slightly peeved! and not sure how tackle SF I seen to hit a brick wall each time I ring them..


they claim I was overpaid in 2011/12 a grant for ADG of £2,642 and have taken it off my award for this year 2013/14


me and my partner split in term 1 of 2011 and when I applied for funding this year they requested finalisation for 2011, I sent them bank statements etc as they requested.


the guidelines state...


"Adult dependant’ means, in relation to an eligible student, an adult person who is dependent on the student, other than the student’s child, partner (including a spouse or civil partner from whom the LA/SLC considers the student is separated) or former partner."


when we split I did pay her each week... not because I wanted too I begrudged it but legally I had too.. she went to a solicitor and he told her as she never worked and relied on my income during our relationship I legally had to subsidise her til she got on her feet so to speak.. so not only did I have child, mortgage etc to deal with I had to pay her lazy !!!!


now I sent in my evidence to SF and even stated the guidelines state the above and still its on my account as overpayment..


is there anything I can do.?
this deduction has left me minus £2,642 in this years award and I am struggling financially.
my Access to learning fund at uni wont help as they claim I have to have as much as im entitled too from SF.. they tell me to go to SF and ask for them to defer the overpayment til course is complete as taking it off me this year is leaving me in financial hardship.. SF today said on the phone I am unable to request that..


what can I do any advise or help?
I have read the guidelines and still im stuck for direction.

    I'd question the advice she received, if she actually received it at all! Spousal maintenance is very unusual these days, particularly if the couple was never married.
  • no its still legal and wasn't so much as the issue its the fact its in the guidelines and getting no help or decent advice on what to do next is my concern.


    and we was married.
