Appealing to POPLA based on what they will see as mitigation and without using phrases we know will win is very unlikely to be successful. You can add to your appeal and we can supply you with the wording to use. Would you like this or are you happy to let your appeal stand as is?

I understand. In fact that was one of the reasons I posted here in the first place.

I am quite happy to change/add anything into my appeal.

I sent you a PM with the letters I exchanged with popla and TSS.

Many thanks to everyone for the help/advice.
  • It is vital that you add to your appeal and quickly. You can email POPLA (put your POPLA reference number in the email title)

Follow the advice given from the previous posters - it will be 3 main points (no authority, No GPEOL and Non-compiant signage.

I have no idea what i should add.

Yes you do - I advised you to read the hyperlink 'How to win at POPLA' in post #3 of the newbies thread - everyone can write an appeal based on those examples. You should include 'unclear signage as well as no GPEOL and no contract/authority paragraphs as you see in the examples.

I got your pm and the sign is unreadable, brightly coloured but small font, and looks like it relates to the space to the side of the garage.

Can you tell us what the actual sign SAYS ( all words).
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

POPLA appeal update submitted in time. TSS Ltd bottled it and failed to make any submission. Appeal upheld.
"The Operator has not produced a copy of the parking charge notice, nor any evidence to show a breach of the conditions of parking occurred, nor any evidence that shows what the conditions of parking, in fact, were."
My very sincere apologies for those hoping to request off-board assistance but I am now so inundated with requests that in order to do justice to those "already in the system" I am no longer accepting PM's and am unlikely to do so for the foreseeable future (August 2016). :(

For those seeking more detailed advice and guidance regarding small claims cases arising from private parking issues I recommend that you visit the Private Parking forum on PePiPoo.com
