So the conclusion is that anything could happen? They could refund the buyer and let her keep it, even though I've offered to do a refund when returned but she is refusing to play ball?

Um, it is looking that way lol. However, if they refund without her returning it then you can appeal.
I think cases time out after 30 days if not escalated. Sure someone else can confirm when it times out.0 -

I am still of the belief that if it goes to the wire you will not be forced to refund unless buyer can show via tracking that an attempt has been made at delivery to your address. It's really annoying when something arrives which isn't right; in my opinion the seller should put the buyer back in the position they were before they bought it, including refunding postage.
It would stop sellers selling dodgey stuff and using the high price of postage as a deterrent for having to issue refunds.
Some time back I was selling items from a job lot of stuff, and whenever I had a buyer complain, I'd just get them to hit the item with a hammer and send me a photo of it, and I'd then refund them in full.0 -
But nobody is saying that this seller sold a dodgy lipstick item.
There has been a huge surge in buyers claiming an item is damaged or has something wrong with it of late & many of them find the item good enough to want to keep, yet want a discount on price paid, which is often around 50%.
There are definitely some bad sellers, but equally there appear to be an awful lot of bad buyers too.The bigger the bargain, the better I feel.
I should mention that there's only one of me, don't confuse me with others of the same name.0 -
Put it this way, it was unused when I sent it, she then took a photo of it and said it was used ('and look, you can see in the picture!)
So what is to stop someone using a lipstick themselves and then saying it is used, in order to keep money and lipstick (as she insisted I refund without return at first).
I'll lose money anyway as I can't resell it now, so the stock is worthless to me but I'll be damned if she's keeping it. And I'm actually quite glad the international tracked postage is so much in this situation!0 -

Everything to do with the huge banner advert promising buyers they are guaranteed their money back if it's not as described?
I won't ever partially refund. If it's not right then no amount of money should make it right so just return the widget for a full refund. And btw while you're about it, open a case first... I have had a few people message me to ask for a partial refund but I've never heard from them again since asking them to open a case for SNAD.
Even the ones who were absolutely heartbroken/devastated that it wasn't right as they now have no present to give... :cool:0 -

I agree up until the tracking as I always thought once posted back buyers were supposed to supply a tracking number. There have been those on here who haven't sent tracked and ebay haven't refunded them and the sellers claim to not have it and won't refund, as well as those who have sent tracked and only been given a refund after providing the number.
I don't want to argue about it though. Despite having a system it seems ebay do handle things in various ways. OP at least has an idea of the different outcomes. As you say, they have the option to appeal if they do not win the case.

The case system changes apropos timescales (for current users) on 17 Feb and the wording is slightly ambiguous to say the least (I am/was a contracts lawyer so wording for me is über important - even if my ipad doesn't agree!)0 -

A case timescale is that after 8 days the buyer or seller can escalate. If it isn't escalated it times out 30 days from opening.0 -

If the case is escalated the chances are the buyer will win ie they will be told to send it back. Once they do this, and you receive, or refuse it, it's an automatic refund. BUT you have an appeal. IMO you should gather your evidence, ie photos, messages etc and RING eBay first and ask them to give you an email address to post your appeal.
If you win the appeal eBay will reimburse you and they will remove or prohibit feedback from the buyer.0 -
