Can I Reclaim PPI after an IVA ?

I had 2 credit cards with Mbna approximately 12 years ago I was paying ppi on one of them but am unsure about the other.

I then ended up doing an IVA from 2005 to 2010 and these cards were part of the IVA.

Am I still able to reclaim PPi from these cards ?

Comments

  • You can but they can put any redress toward any money that they were forced to write off as a result of your default.
  • I carried out an IVA from 2005 to 2010, I completed the IVA successfully. I have recently attempted to claim PPI from MBNA for 2 credit cards that were part of the IVA.

Mbna asked for a copy of the IVA proposal which I provided and I have recently received a reply from them stating that due to the terms and conditions I agreed to within the IVA I cannot claim PPI. They said this is their final answer and if I wanted to take it any further I should go to the financial ombudsman.

I don't remember anything in the terms and conditions that of my IVA that mentioned PPI or re claiming terms. My IVA supervisor also did not mention anything about claiming back PPI, and I know that nothing was claimed for and put towards the IVA.

    I have read this link

    ivaadviceforum co uk / ivablog / ? p = 123

about the eligibility of claiming ppi after an IVA and this was actually written by someone involved in the setup of my IVA

Should I take my complaint further and contact the ombudsman ?

Any additional information would be helpful

    Thanks
