EXCEL PARKING - Stockport peel centre, please help!

Long story short:

Parked at the Stockport peel centre, bought a ticket, did not know you had to put your registration number in.

Got a parking charge, luckily kept the ticket so appealed. Failed so appealed to POPLA. Failed again, since found out you have to word it very precisely to get the mitigating circumstances nod. I was just honest and said I had the ticket and could prove we paid. Failed.

Went to CAB and my local MP. Failed again.

They stated there was a voice over at the machine, so there was NO excuse that my husband (not a British national) didn't hear it.

This was a lie, as I parked there the week before with my mother and she confirms there was no voice over, we went back the week after, no voice over!

They said they had it installed in sept 2012. If this is true it was NOT activated.

We have the man at the car park saying it was a new system (in sept 2013) and myself and my family saying it was not there.

Is there anyone else out there who can confirm there was no voice over assistance at the Stockport peel centre manchines??

We paid the £1.30 we stayed for 22min only 7mins over the free time anyway.

The machine was broken, we just don't know how to prove it.

Any help would be invaluable.

    doesnt really matter if you can prove it or not in my opinion it wont make any difference to where you are at now

    I assume you have not paid the parking charge, so all they can do is mither you with debt collectors and ultimately they can take you to court and then a judge decides, proof or no proof , the judge may decide in your favour on a completely different issue like no contract or not a genuine pre estimate of loss

    in other words its your word against theirs, and in court a judge decides based on all of the evidence presented

    the 2 main ways of winning in court (or at popla) over the Peel centre and excel are , no contract and not a gpeol , which would be the 2 most important points to raise if it went to court. obviously you can also raise these issues of yours, but if the judge asks them for locus standi and they dont have it , he or she will dismiss the charge and your issues on voice over wouldnt even be heard

    Stop worrying about voiceover because, got to be honest, now Excel will take you to Small claims court (not such a big deal, just a final decision) and at least we can help you with a defence - which will NOT rely upon that detail you seem to have been so focussed on that you missed the bigger picture.

    What a wasted opportunity for the sake of a Google search of 'How to win at POPLA'. Don't also waste your court defence with such weak stuff used in the POPLA appeal and don't waste your time at the CAB.

    Have you got your 'Letter before Claim/Action' from Excel yet? When you do you need to immediately acknowledge then respond as per the LBCCC Fightback sticky thread on here.

    lauren,,please do not worry about the scum known as excel parking,stick with this forum/advice and you will spank them hands down if it did end up in court,as c-m says,do not worry about the voice over nonsense,its been in situ a while i know that on occasions you can hardly hear it,,thats by the way,the important thing is you have the ticket scum excel will try it on with you,harass,lie,etc etc,do not lose a moments sleep over this,but DO NOT ignore,cab are as much use as an ashtray on a motorbike,,you may recieve further further threat o grams,but follow advice given and you are on a winner.
    finally scum excel monitor this forum daily,so do not under any citcumstances respond to any pms you may recieve especially from someone with a low post count,check back here first,as it may be a wolf in sheeps clothing,meaning excel,we cost them £1,000-00s of pounds in lost scam revenue,,good luck and dont worry.
