What to do when the other person won't contact their insurance company.

    Get the details of the insurer off https://www.askmid.com and contact them directly.

    If there is no insurance shown, contact the police. You can then claim from MIB under the uninsured driver agreement. You MUST contact the police within a set timescale in order to be able to claim under that scheme.http://www.mib.org.uk/Submit+a+Claim/en/Default.htm

  • Isn't it an offence for him not to report the accident? Either to the insurer or the police?

    He should have give full details at the time of the accident.

    No "offence" committed by not reporting to your insurer.

    And no need to report to police (no injury, both drivers exchanged details at the scene)

    This happened to me. The TP insurers won't play ball unless their insured reports the incident. You will have to send a letter before action to the TP for the estimated value/cost of repairs to your car and give them a week to pay up or you will commence action through the courts. When I did that, surprise, surprise, the TP finally reported it to their insurer. But do check he is actually insured.

    Most councils bar cars from being used as minicabs when involved in an accident until they've had a council test re-done. I'm my area the council test is basically an mot and tick box for things like 'extinguisher in car' blah blah blah

    Rather than the LBA I got an accident management co. involved and surprise, surprise the 3rd party insurer was on the phone within hours of initiating the claim to sort it out. ;)

    That's another possibility but beware of them saddling you with an expensive hire car on a credit-hire agreement whereby if they don't recover the cost from the TP, then you become liable for it yourself.

    Well aware of this but it would be quite a rare event of this actually happening.
  • If I may offer my experiences...

    I used to do a lot of traveling and was unlucky enough to wind up in three separate accidents whereby someone drove into me. Twice hit in the rear in traffic and once side swiped when lights weren't in someone else's favor. So essentially, all non fault on my part.

    The first accident, I claimed off the third party's insurer myself and it was a complete hellish nightmare. Trying to get a reasonable value for the car they had written off, disputing charges from highways agencies and, added to that, I had no car to get to work in and was paying well over the odds for public transport until it got sorted.

    Last two times, I claimed directly off my own insurer and paid my excess. When all the wrangling was done, both times I got my excess back, my no claims bonus was unaffected and I didn't have all the major headaches in dealing with an insurance agent who was trying to skive me every single phone call. Added to that, my insurance policy provided me with a courtesy car both times while my car was sorted or, as in the case the last time, my car written off I had the courtesy car for two weeks after full settlement!

    My advice: If your own policy allows for a courtesy car, claim off your own insurer every single time. Let them do the hard graft.

    Secondly, in contrast to some advice here, never EVER EVER touch any of those credit hire companies. Just google for them (Albany Assistance, etc.) Just REALLY - no!!!

    If none of the above is possible, then I'd recommend you get yourself on eBay or gumtree, and find a £500 junker with 12 months MOT and some tax. I found exactly that last time round and it's doing perfectly fine as a go between. It's not glamorous, it needs TLC, but it sure beats walking in this weather! And my air-con works!
