Parking Eye Court Claim

Hi - I need your help!

I took my kids swimming one rainy morning in October but couldn't park in the swimming pool car park as it was too busy. Having waited 20 mins (with kids becoming increasingly impatient!) I gave up and parked in a retail park car park that we use regularly, blissfully unaware that it was patrolled by Parking Eye. We waited an hour to get into the pool and so subsequently exceeded the 2 hour limit on the car park and my wife, therefore, received a £60 'fine'. Having looked on this site I ignored it and excepted them to disappear. However, when my wife was threatened with court action I re-read the advice on this site which suggested I should write to parking eye confirming I was the driver, which would then reset the claim and I could appeal. Despite writing to Parking Eye to this effect in December, my wife today received a court claim for Northampton County Court requesting settlement of £165! Unfortunately I have lost my proof of postage for the letter that was sent in December.

I appreciate that I have a fairly weak case but still feel that the level of their initial 'fine' is hugely excessive for the original misdemeanor. It certainly didn't reflect the loss to their business of me being there, particularly as the car park was empty! Clearly the cost to settle has now increased significantly.

What is the best advice? Do I just settle up and accept my losses (which would be painful) or could I still successfully fight these scammers?

Any help on offer would be much appreciated so thanks in advance.
