    It should read, We have consistently provided the highest levels of scamming to our clients victims!
    PPCs say its carpark management, BPA say its raising standards..... we all know its just about raking in the revenue. :eek:

    DRP (including the other trading names Zenith and PCS I presume) dropped out of the CSA didn't they, so I think that makes their PPC clients in breach of the BPA CoP...so in a different way they too may have been the authors of their own failure.

    The BPA CoP is silent on the debt collection process.

    HOWEVER the KADOE agreement, which is the contract with the DVLA that each and every PPC signs before being allowed access to the DVLA electronic link, states the following (Clause C3.1):

    The Customer [i.e. the PPC] shall abide by the OFT Debt Collection Guidance whenever it seeks to recover payment of unpaid Parking Charges from any person.

    Well we know that most PPCs and their debt collectors do not abide by the OFT guidance, and in some cases the breaches are egregious.

    This is potentially very important because:

    1. Under its own terms, the OFT Debt Collection Guidance applies only to debts arising from regulated consumer credit agreements i.e. not PPCs; the KADOE agreement makes it apply to PPCs also; and

    2. The KADOE agreement is an agreement between the DVLA and the individual PPC, the BPA Ltd. does not enter into it. When you complain to the DVLA about companies ignoring the BPA Ltd. CoP, the DVLA supinely passes the buck to the BPA Ltd. which, as we know, does nothing. However, if you complain to the DVLA about a PPC or its debt collector breaching the OFT Debt Collection Guidance the DVLA cannot pass the buck because it's a breach of a contract the PPC has signed directly with the DVLA.

    Really surprised people don't get advised to complain to the DVLA on these grounds, because they apply in just about every case which gets to the debt collection stage - and I don't just mean when the debt collector gets involved: if the PPC itself writes letters chasing the money then they too need to comply with the OFT guidance.

    My very sincere apologies for those hoping to request off-board assistance but I am now so inundated with requests that in order to do justice to those "already in the system" I am no longer accepting PM's and am unlikely to do so for the foreseeable future (August 2016). :(

    Yes - the DVLA have, in general, been very weak with PPCs and keepers' details are the very lifeblood of the whole scam. A raft of complaints might just force them to take the issue more seriously.
