Parking Charge Notice Civil Enforcement Ltd

I have recieved a PCN from Civil Enforcement Ltd and am not sure whether to pay it or not. They are asking for £100 within 28 days or £60 within 14 days. It was a free car park for 90 minutes but I stayed for 2 hours. I cannot afford to pay the £60, never mind the £100. There are mitigating circumstances for being late but am I right that POPLA will not accept this? I stupidly thought that, as the signs stated FOR CUSTOMERS ONLY, I needed to go in and shop at Poundstretcher. I was within the 90 minutes when I returned to the car park but spend the rest of the time in the shop being a customer of the car park. It was this reason that I was late. I have proof of shopping in there but when I went into the shop to ask the Manager about withdrawing the notice he said that the company was nothing to do with them so they couldn't help. I have various creditors whom I am paying £1 per month because of low income. Please can anyone help and advise course of action?

    Send via email and through the post with a free proof of postage from the post office


    Dear Civil Enforcement Ltd,

    As the registered keeper of (reg) I'm in receipt of your parking invoice xxxxxx dated xxxxxx. I wish to invoke your appeals process as is my right under the Protection of Freedoms Act 2012, all liability to you company is denied on the following:

    1) The amount being claimed is not a genuine pre-estimate of loss to your company or the landowner
    2) Your signage does not comply with the BPA Code of Practice
    3) You are not the landowner and do not have the capacity to offer contracts or to bring a claim for trespass

    These points and others will be raised with Popla should you not accept this appeal, and you will be expected to provide a full breakdown of your alleged loss, and your full unredacted contract with the landowner.

    If you do reject the challenge and insist upon taking the matter further I must inform you that I may claim my expenses from you. The expenses I may claim are not exhaustive but may include the cost of stamps, envelopes, travel expenses, legal fees, etc. By continuing to pursue me you agree to pay these costs when I prevail.

    Please issue your cancellation within 35 days of this letter or a popla verification code. I have nothing further to add.

    We don't need the following to help you.
    Name, Address, PCN Number, Exact Date Of Incident, Date On Invoice, Reg Number, Vehicle Picture, The Time You Entered & Left Car Park, Or The Amount of Time You Overstayed.
