UKCPS Parking Fine, Appeal rejected

Hi all,

I got a parking charge notice at the beginning of January when parked in a private car park under a block of flats, which was empty and I had been parking there for a year or so beforehand and did't have any problems!

Anyhow, I had a good read of the sticky post relating to private parking fines and sent a letter to UKCPS enclosing a slightly altered soft appeal, however much to my disappointment, I received the following letter yesterday...:(

Any advice would be greatly appreciated!

"ISSUE NUMBER ****** REASON FOR ISSURE: Without valid permit or authority and all the other details etc.

APPEAL REJECTED

Dear ****

UKCPS can only address the factual issues of where and how you parked. We will not enter into discussions about the legality of parking on private land or of the right to impose parking conditions on their property. As your appeal has not been rejected for the reasons stated, you may now 1 Pay the Parking Charge Notice within 14 days. Please note that after this time any discounted rate, which may have existed, will not be applicable and the Parking Charge Notice will be 100GBP. 2 Make an appeal to POPLA. The Independent Appeals Service by making your appeal online at POPLA Website. If you opt to pay the parking charge you will be unable to appeal to POPLA 3 If you choose to do nothing, we will seek to recover the monies owed to us via our debt recovery procedures and may proceed with Court action against you. Your unique 10 digit reference is

    Have they given you a popla verification code to go to popla?
    When posting a parking issue on MSE do not reveal any information that may enable PPCs to identify you. They DO monitor the forum.
    We don't need the following to help you.
    Name, Address, PCN Number, Exact Date Of Incident, Date On Invoice, Reg Number, Vehicle Picture, The Time You Entered & Left Car Park, Or The Amount of Time You Overstayed.

    It is the code, just read the newbie thread for linked in popla appeals that you can use, once you've found what you need post a draft here so we can advise you on the wording if its needed

    'How to win at POPLA' is a hyperlink in post #3 of the NEWBIES sticky thread and this should be fairly easy to win.

    But can you show us a picture of the sign on site? I saw a case recently where UKCPS had worded the sign as if the charge was a contractually agreed fee for parking. Makes a difference to the POPLA appeal. If you can host a photo of it on photobucket you will need to post a broken link for us (remove the http:// and put a gap in the URL). We can then convert it back.

  • Hi guys, sorry this has taken so long but didn't have the chance to get through to the car park until yesterday! Here is a photo of the sign:

    Also, when I put the code in the code checker, it says:

    "Grounds for complaint
    This code was generated 2 day(s) before the date of your appeal rejection letter. This means that you have not been given the full 28 days to appeal that you are entitled to under the British Parking Association's Code of Practice. Please consider making a complaint."

    Hi all, would just like to say a big thank you to everyone, and a big shout out to Coupon-mad for helping with my appeal, as I received an email today saying that the parking ticket was to be cancelled!

    Yay!! I will use that POPLA appeal wording that I pm'd to you, for others with that same UKCPS sign. They can cancel them all if they are not up to the fight.
