Car Deposit Paid
Hi
I have recently put £600 down as a deposit for a car with the caveat that a few niggling issues be resolved pre final payment/delivery
It would appear that the garage is now struggling to repair one aspect (electrical) as part of the agreement. Its now been 10 working days...
So.. question...
At what stage do you think that the deposit becomes refunadable (if at all?)
Clearly if the agreed repair cannot be made I should be refunded, but this question really refers to the amount of time I should be expected to wait?

If it is a LTD trader, basically only if they are good willing.
Legally there is a recourse, but with car dealers you usually end up throwing good money after bad.
Deposits and car dealers are a perfect cake mix for loosing your money .
Never leave what you are not prepared to surrender.
Buy with cash on the nail, or find a better car without issues.
If this is a tin pot fly by night dealer, you might have made a £600 error of judgement.Be happy...;)0 -

certainly not a fly by night dealer, but not a main dealer/franchaise
just wondered if there was some consumer protection data that could be quoted? as in real terms I could still be here next year waiting!0 -
How did you pay?
If it gets iffy then you can take it up with the credit card supplier (if you used one).
Is there a delivery date on the reciept/invoice at all? How long are you prepared to wait? What has their attitude been like when you've called?What if there was no such thing as a rhetorical question?0 -
I paid with a Debit card
No agreed date verbally or otherwise
attitude has been pretty good tbh which is what leads me to believe all will be done above order
its just when we get to the stage of (if we do) that it cant be fixed, whats my options if i get the decline to the refund...
i am probably a bit paranoid bt 10 days (today) seems a bit long...0 -
If their attitude has been good, I am sure they are doing their best to fix your problem. I'm pretty sure that they are wanting to sell the vehicle as much as you want to buy it. If the dealers are good, then they will get to a point where, if it cannot be fixed as agreed, they will have to offer you a refund.
If, the problem is fixed, then I'd make sure that the car goes on a test drive before you part with the remainder of the money, &, I'd request a drive up the motorway at speed too (that's of course if the electrical problem is something that could occur when driving at speed)
I don't see why you shouldn't get your full deposit back, after all the problem is theirs, it's not like you have backed out of the deal & have caused any expense to them...0 -

What rubbish. But firstly, not all dealers can be assumed to be legal crooks abuseing the companies act for short term gain. Contract law applies equally to all types of setup, whether ltd or sole trader etc.
Op you can rescind from the contract if uou haven't been deemed to have accepted the goods and if they breach the contract. In the absence of explicit terms then it would be whàtever is a reasonable timescale.
So the only debate really is at what point becomes unreasonable time0 -
Ask them why it is taking so long to fix/obtain a part. Sounds like they don't have a decent workshop behind them and that doesn't sound good if you go ahead with the purchase and find more niggling faults.0
