Smart Parking

Hi guys, i'm looking for a bit of advice regarding a recent parking charge notice. i was parked on a piece of land near a local retail park (not obstructing pedestrians nor traffic). the "ticket" states that there was a notice left on the windscreen of the vehicle however there was no ticket left on my vehicle or other vehicles parked in the same place although i cannot say whether the other vehicles have also been stung by these charges. the ticket was issued by Smart Parking LTD. the ticket also says the discounted period is over an that they want me to pay £90. they also request for me to contact them by 01/02/2014 but i only had the letter today.

any advice would be brilliant! cheers, jordan

  • terribly sorry, i still don't really understand what to do. should i appeal as there was no notice on the windscreen? should i just ignore it? this is a first time experience for me and i dont really have £90 lying around

    if its england or wales you should always appeal, then get a popla code and beat them at popla

    Dear xxxxx

    As the registered keeper of (reg) I'm in receipt of your parking invoice xxxxxx dated xxxxxx. I wish to invoke your appeals process as all liability to your company is denied on the following:

    1) The amount being claimed is not a genuine pre-estimate of loss to your company or the landowner
    2) Your signage does not comply with the BPA Code of Practice
    3) You are not the landowner and do not have the capacity to offer contracts or to bring a claim for trespass

    These points and others will be raised with POPLA should you not accept this appeal, and you will be expected to provide a full breakdown of your alleged loss, and your full unredacted contract with the landowner.

    If you do reject the challenge and insist on taking the matter further I must inform you that I may claim my expenses from you. The expenses I may claim are not exhaustive but may include the cost of stamps, envelopes, travel expenses, legal fees, etc. By continuing to pursue me you agree to pay these costs when I prevail.

    Please issue your cancellation within 35 days of this letter, or forward a POPLA verification code.

    Yep you can send that online, costs nothing, and Smart usually cancel when they see those words!
