Uk cps parking ticket - is this reason to appeal?

Thank you for your advice redux, I shall await contact. I've also contacted the management company to find out who has authorised the sign going up and ticketing on this car park
Coupon-mad - apologies if I have offended you by asking a question. I appreciate there will always be duplication on forums which obviously annoys you however having read the stickys i am still confused hence the question. There are a number of sites on the internet with conflicting advice and not all of us can be as superior and clever as you. So please do feel free to not read my posts which was obviously about whether to appeal - a subject you seem 'sensitive' about
You were directed to read the stickies thread concerning parking tickets.
There is a wealth of pertinent up to date info there.
If you are confused read it again and then if you have a specific question feel free to post.
People like Coupon-Mad take a lot of time and have gone to a lot of effort to help people out, but people need to help themselves. Using the "search" function is a start as is reading, carefully, the relevant information.
If that seems rude to you and you are offended by my comments then tough.
Frankly I don't care, newbie or not.0 -
fisrt , the name is redx , not redux
and no newbie bashing isnt the norm , but it happens mainly because those newbies are not familiar with the forum, not familiar with the subject, skim read , read old and out of date posts and threads, hijack other members topics, dont use the forum search tools , dont do the research , dont spend time reading the correct advice and understanding it, dont give enough information but expect questions to be answered, rarely help others but want the undivided attention of people to help them solve the problem at nil cost
they are also the ones that tend to pm other members like coupon-mad wanting personal help instead of using the forum
we accept that you may not know the subject , neither did we when we first looked on here, but it takes time to build up the speed and knowledge and if you dont wish to part with £100 then you have to learn it all too
this is why I directed you to read the NEWBIES thread by coupon-mad where its all explained in great detail, its kept up to date and is "stuck" to the top of the forum so that newbies can read it
if you are a newbie to anything, you need to use your time as a newbie (apprentice) to learn about the trade , like a learner driver isnt allowed to compete in formula one or allowed on a motorway with the "professionals"
all we ask is that you read and learn , we were all newbies once, and were told the same if we hadnt done the apprentice time learning the topic
all newbies are told to read that thread , so nobody gets different advice here, its read, learn , deal with the problem, answer questions if and where necessary and hopefully you will get the free advice you need
what you need to remember is you are not paying for this advice, its given freely by hobbyists and aggrieved motorists who went down the same road before you did , or learned the topic to help relatives or friends caught out by these sc*mm*rs
this isnt facebook and we are not your friends, we may give advice but sometimes its easier to deal with people at school than some adults , my grandkids can run rings around many adults when it comes to laptops and forums, luckily not me as I fix laptops and consoles etc0 -
Thank you prowla. Is newbie bashing the common theme on here?! Just noticed I have a newbie alert which does say 'be nice' !! I understand now I should wait until I get a notice however what reason do I then give for appeal?! Confusion over the double yellow? Unlit sign (can I get away with this when I live here?!). I'm worried about them logging something against me that might impact my credit file. I'll hang fire thought and sorry for the ramblings
The problem is that many people read the Newbies sticky but don't take it in. As there's a lot of info in it I suggest you re-read it but this time with a pen a notepad and jot down notes about the bits that are relevant to you and your situation.
For clarity though ( and this is a brief summary of the thread ) :
1. Await Notice to Keeper
2. Appeal to the PPC - use anything you like but unclear signage seems a good one in this case
3. If rejected use the POPLA code by appealing to POPLA. *** ONLY APPEAL TO POPLA AFTER GETTING YOUR APPEAL CHECKED HERE ***
Unless you are very lucky and someone offers to write the POPLA appeal for you, you will need to put some effort into reading the stickies and formulating your appeal."The darkest places in hell are reserved for those who maintain their neutrality in times of moral crisis." - Dante Alighieri0 -
1) I understand now I should wait until I get a notice however what reason do I then give for appeal?!
2) Confusion over the double yellow?
3) Unlit sign (can I get away with this when I live here?!).
4) I'm worried about them logging something against me that might impact my credit file.
5) I'll hang fire thought and sorry for the ramblings
1) this thread https://forums.moneysavingexpert.com/discussion/4879819 contains the best soft appeal for almost any "circumstances"
it also contains the 3 main points you appeal to popla or the ipc with too (irrespective of if you understand them or not)
2) if it is private land then the double yellows are not really relevant compared to public road use , but no reason it cannot be mentioned but I dont see that they will care about anything you deem is relevant and especially not yellow lines
3) Poor or bad signage is always relevant and its in that soft appeal and will feature in your popla appeal too
4) the only way this can happen is if you get taken to court, lose , obtain a CCJ and do not pay it within the time period (say 28 days for easy terms - but whatever the judge stipulates anyway)
its the non-payment of a CCJ that affects your credit rating , not the payment of it within its time frame, which therefore negates the CCJ from becoming "live" (as I understand it)
this is just an invoice issue about parking, not a GBH criminal issue so isnt that important in the greater scheme of things, yes you are aggrieved, and that is what muddies the waters as you feel innocent of any "crime" and wish to shout it from the rooftops
all these people wish to do is extract the money from your purse by any means necessary, be it fair or foul , all we wish to do is keep your money in your purse and cost them money at popla in the process, thereby teaching them a lesson !!
5), yes , please do so, come back when you have the NTK in the post, which we advised you to do all along, in the meantime bone up on all this process so you have the tools to fight and win
remember, these are the 3 points you need in any appeal , to anybody1) The amount being claimed is not a genuine pre-estimate of loss to your company or the landowner
2) Your signage does not comply with the BPA Code of Practice
3) You are not the landowner and do not have the capacity to offer contracts or to bring a claim for trespass0 -

It's also worth noting that the folks do put in a lot of effort to help out, and I guess the same question repeatedly can lead to a bunt answer.
I suppose it's better to get a snippy reply from someone who is helping you, than it is to pay a load of shysters your hard-earned for transgressing of a non-existent law.0 -
Thanks again redx. Apologies re the typo - ipad autocorrect. If I were being pedantic, I would say its 'first', not 'fisrt' ;-)
But seriously, thank you for your advice. I totally agree I am unfamiliar with the forum however I do want to state that individuals have very different learning styles. To sit and self research on a forum would be classed as solitary learning which is not a strength of mine....
Hot Bring - very useful and thank you for your help0 -
yeah, I am registered disabled from A.S. and also seem to have a very mild form of dyslexia so have to constantly edit my posts (on a laptop) so spelling mistakes do occur which I often put right causing the forum to show my posts as "edited" , even had to edit this post as well over a dozen times before hitting the "send" button
doesnt change the fact that what I write after over 30 years in the comms industry writing fault reports and "clears" for faults is factual as far as I know , but can be devoid of emotion same as CM posts can be , this is what happens when a professional writes a reply or letter or report , we are taught to only put the facts in and no emotion, which comes out very cold and blunt and may appear to the untrained eye as being "superior" or pedantic , its the way it is and I do not apologise for writing in this style after over 30 years of troubleshooting faults and repairing more faults than anyone here has had hot dinners
it needs some people to be focussed and pedantic to get things done and cut across the emotional side and get to the point and the solutions , you will see this with those in the dragons den , r. branson (who is also dyslexic) , a m sugar , karren brady etc , they dont take prisoners and dont accept waffle , but tend to get the job done by getting down to the nitty gritty
that is how I get anything I do done too , makes no difference to me if I am liked or not , I dont do facebook or twitter either, but if I see a problem or a fault I like the exact details, do the research, look for the fix and try to fix it, but if its beyond fixing I look for the lesson to be learned for the next time it appears (which on this forum it does daily and constantly)
ie:- I am what I am , warts and all, so is coupon-mad, but damn I respect her opinion and am constantly amazed by the letters she writes to shoot across the bows of these idiots in charge of private parking companies, especially if they have ignored the laws of this land
explanation over (and about 30 errors edited too)0 -
I'll openly admit to my eye being untrained ;-)
Thank you though, as before I do very much appreciate your advice0 -

Sorry Flosmum - there are things going on in my life this month connected to a bereavement back in August - makes me snappy sometimes. I am going to make a concerted effort not to be so harsh from now on as that's not what I am really like at all (I am a nice Mum of 4 kids really!).
Hope you found the advice you need to appeal, which is standard stuff and nothing to do with confusion over a double yellow or an unlit sign.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

I'm sorry to hear that and apologies also for my reply. I know how annoying duplication on forums can be. I am hanging fire for their next letter then replying with some of the details off the post and stickys - the info in there is fab. I'm just rubbish at reading and taking in when I don't understand. Am getting there though and thank you for your reply0
