Hi,
I was using a friend's car last week and was at one of the hotel's that use ParkingEye. So it was dark and I didn't notice the parking sign and there were no pay and display outside of the hotel.
Anyway, I've read all the threads and it sounds to me they cannot enforce any legal fine (as it is a charge).
While I would let them waste their time and money on posting to me they are writing to the registered keeper (my friend). She is more worried about going to court, rising costs etc (with their bully boy tactics). On the letter it states to the registered keeper, "we will pursue you for any parking charge amount that remains unpaid."
So I want to tell them she was not the driver, but also I want to keep my own details private as they have no legal powers over me. Is there a privacy / data protection law that will assist me? Also is there a way I can threaten to charge them for my time in responding to their threats? I hate this sort of bully boy tactic they use to worry people, bring it on!
Be interested in any responses. Thanks.

starting a new thread entirely of your own would have been a good start instead of hijacking somebody elses thread and case
I shall ask a forum staff member to split this thread for you

Yep but has to be done the right way, woofers! The keeper responds online to PE giving your name and address as driver. YOU don't volunteer your own details, that doesn't work. The keeper uses the template response below:
Dear Sir
PCN Number xxxx
Vehicle Registration Number xxxxx
I am the registered keeper of the above mentioned vehicle. I am writing to acknowledge the Notice and to inform you that I was not the driver of the vehicle on the date of the alleged 'parking event'. Therefore you must pursue the driver, whose details are:
[INSERT NAME]
[INSERT ADDRESS]
PLEASE NOTE: This discharges my obligation as Registered Keeper under PoFA 2012 and any court proceedings will be defended on that basis.
I look forward to receiving confirmation from you that you will cease all further action against me with immediate effect.
Yours faithfully
PRINT NAME (the keeper)
Stop worrying about your name and address being used. If you follow the advice in the sticky thread already linked for you to read, you will simply win at POPLA as we always do against PE. This is no big deal.
The alternative is to do the appeal in the keeper's name throughout - but it makes no odds as long as you/they read & learn how to win at POPLA!PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

bear in mind that if this is england and wales they certainly CAN take the keeper to court IF they have followed POFA 2012
so stop giving advice to your friend UNTIL you have got the proper advice in the first place
lol
they then pursue the driver IF the RK has given them the driver details ( ie YOU) and then its you that defends it or at popla or in court
the advice only being different if scotland or northern ireland0
