Divorce but no financial settlement

I separated nearly 6 years ago and got divorced about 3 years ago but a financial settlement was never made as there was no assets - the house was re-possessed and I was only been left with debts - he has gone bankrupt since - in the past my ex has asked me for a 'final relief order' - I'm not sure if I need one as no assets but could he come and claim settlement in years to come if for some reason I came into some money ? And vice-versa?

    You'll need too get a solicitor to draft the actual Consent Order, however it is possible to do the court forms yourself to save a bit of money. It depends how complex you need the order to be and how cooperative you and your ex can be as you'll both need to disclose your current financial positions within the court forms.

    I'm just about to submit our Consent order and forms to the court. I approached a local firm and asked them to quote me a fixed fee for drafting the order. My ex and I have then done the forms ourselves - you can find them here www. gov.uk/money-property-when-relationship-ends/apply-for-consent-order

    Go get a free half hour with a local firm and go from there. You can also try Wikivorce for some extra advice - they've been really helpful to me.

    If it is just a clean break you want then speak to local solicitor to get something drafted. You nad you ex will each need to fill in a statement of information which is a summery of your financial position so that judge can be clear that the order is fair.

    There is a £45 fee to the court when you submit the order.

    As your ex is pushing for it, suggest he get an order drafted and let you have it to approve.

    an order will, as well as stopping wither of you claiming against the other in the future, mean that neither of you could make a claim against the other's estate on death.
