If you haven't received all the information you require within 40 days of them receiving your Subject Access Request, you can refer the matter to the Information Commissioner.

However, his staff are as inundated with complaints as the banks’ and credit card companies’ are with SAR’s. The banks and credit card companies have received so many reprimands that one more doesn't make any difference.

In the meantime, you can always draft your first claim letter so that, when your data does arrive and you've done your sums, all you have to do is fill in the blanks.<O:p</O:p

  • silly question...........but why did you send you bank statements to them?

you should have held on to them and sent them the second letter asking for all of your charges to be repaid.

did you use the calculator on here to total up all of your charges???

To actually answer the OP, you need to send out your next letter to the bank threatening to take them to court as they haven't replied to your request in the timescale you have given them.

If you sent them your statements and not copy statements at this stage I would also ask for them back as they will form part of your defence should this reach court.
