Smart parking charge notice : reason : out of marked bay

Hello ive just come out from asda sutton in ashfield branch to find a ticket enclosed,

Charge of £70 or £40 if payment within 14 days

Contravention: out of marked bay.

I arrived in asda at 10.29 am at which i parked next to a red car on my drivers side which was parked on the white line passenger side. I therfore had to park quite away from it aswell to be able to get out without hitting the car. ( i drive a ford transit van so it us a bit wider than cars) so obviosly my van was over the white line on the passenger side as a result of me leaving room to get out my van safely.

I arrived at 10.29 and was fined by smart parking at 12.21pm

What do i do? I believe this is wrong due to the circumstances.

    You haven't been fined, you've got a scam invoice begging for money off you, smartless are utterly useless scammers, and to date have never done court. So down to your situation is the vehicle a company one or leased etc? If it's not just wait until your notice to keeper arrives between days 29-56 from today.

    Then do a soft appeal to get this cancelled, if they reject go to popla with our help. Please in the meantime read the sticky threads so you can gain knowledge.

    We don't need the following to help you.
    Name, Address, PCN Number, Exact Date Of Incident, Date On Invoice, Reg Number, Vehicle Picture, The Time You Entered & Left Car Park, Or The Amount of Time You Overstayed.

  • What do u mean by scam invoice ? Its from smart parking , isnt this a big car parking ticket firm , the van is my own nice van not a company van.

    Yes they are a parking company that issue fake parking tickets so are scam! Understand that only the council or police issue real tickets, this company has given you an invoice that is all, so asking you to pay. I suggest you read the sticky threads on the main parking forum to educate yourself about the scam industry that is parking on private land.

    Wow, what do you think?! Every fake PCN is a scam - read the sticky thread to learn what to do which is NOT to appeal until the keeper gets the first letter.

    Please also search this forum for 'Smart' and in particular look for cases like yours where there was a windscreen ticket first. The first letter arrives with no keeper liability wording on it so the keeper can win EASILY at POPLA!

    As well as the NEWBIES sticky thread, also read the other one I wrote, 'Successful complaints about PPCs' post #2 which includes LOTS of Asda and Smart complaint links. Follow those examples and get back to the Store and speak to the Manager immediately about cancelling this utter drivel (Store Managers cancel these every week for customers with receipts who complain!).

    I got my smart parking ticket quashed in 5 days, the previous one took 4 days. The more confident and forceful your letter, the less likely they will waste money chasing you. I think the white flag is up at smart parking.

    Yep I also got one cancelled within days, when the NTK arrived and I emailed an appeal pointing out the lack of POFA2012 wording and no GPEOL issues. They don't put up much of a fight when you appeal strongly to the postal NTK.
