I suggest gathering all the evidence you need to fight your corner, regarding expenditures.
Remember, this needs to be evidence, not your 'opinion'....!
The more the Court knows about your expenditure, the more able they are to make a decision which favours you.
The only trouble with an IPO is that, if your circumstances vary in the future [3 years].....instead of simply notifying the OR, so variation can be [immediately] made to payments [up, down, or zilched altogether]....under an IPO, the Court needs to be informed of changes....this requires the BR to apply to Court instead for a Variation of the Order.
Don't forget to show the Court evidence of how co-operative you have been over your period of Undischarged BR...especially hi-liting how slow/dilatory the OR's office has been in responding to the matter?
Your original issue of 'date-of-payment' really was a non-issue to begin with.
The 'date-of-payment can be varied by the OR 's collectors [Moonbeever?]....to suit the BR.....there [used to be] a period of grace of up to 21 days [again] within which payments could be made.
Payment does not have to be made by DD.....it can be made by SO as well....or directly...so the BR actually does have full control over when the payments are made.
All it takes is contact & negotiation with the collectors......
And to add to what has been emphasised above by many..the Court is an arbiter.
And, in my experience of Courts being used by authorities to settle disputes, the Courts ...if anything, favour us, as individuals....[ie, where problems have arisen, the 'Authorities' are 'supposed' to know better....]No, I don't think all other drivers are idiots......but some are determined to change my mind.......0
