I think that if you just pushed it at their chest if they choose to drop it, it's considered to have been served on them. But I am not sure of the legal position there.
I'd be inclined to agree, small claims court is designed for the layman (layman as far as the law is concerned) so if you tried to issue a Letter Before Action to meet the pre-court protocols and they refused to take the letter, or as in ops case they refused to accept delivery then a judge would probably deem it as having been served based on the fact you've taken reasonable steps to issue them their notice. In the same way if you don't know a debtors current address you can serve notice as the last known address and this would be considered served.
I don't think there are any hard and fast rules on what must and must not be done.0 -
When I want a letter served in the motor industry I will get the guys from Lizard Lick towing to do it. I watched that program, despite myself, aghast. Like watching a slow motion car crash...in some cases literally.
Hate the program! Can't stop watching it though!!!

I sent off two letters today as suggested by Tizerbelle so now we wait to see if they respond to the deadline.
Arcon, we've had the car three weeks and for two of those weeks it's been in the garage. Basically, the garage have now said its a case of stripping the engine or replacing the engine. It's been driven around 20 miles! I'd accept wear and tear... I've had plenty of cheap cars over the years but we've been sold a dud. Its only done 50000 miles or so.
Anyway, thank you all for the interest, advice and replies. I'll post back in a few weeks with any progress... Good or bad!0 -
If it happens that you do need a signature on delivery (and I ddon't know if you actually will), what abour sending it via courier in a box? My thought being that if they think it is something interesting they are more likely to accept it, rather then a recorded letter that they are thinking is spelling trouble for them?0
