Wasted £3,000 and 6 months - Barnard Marcus even lie about legal!

Hi all,

Want to share my experience with Barnard Marcus Ealing. Hope others won't experience what I just went through...I wasted at least £3,000 and half a year of my time.

The property was Ebbette Court in North Acton - the agent put it back to the market today due to vendor's solicitor failed to get land registery certificate. The agent and seller have been pressuring me to force exchange the contract without completion of legal process after 4.5 months. My solicitor and I refused so we cancel the transcation. When a friend of mine called the agent, the agent claimed that the property didin't sell becasue I had not enough money! They have no ethical standards at all - I don't want another victim who may settle because they threaten you! You can get into deep trouble and the agent will take no legal responsibility whatsoever.

I put the offer of asking price in August,2013. Being pressured to use their mortgage broker and lawyers.

1. If you don't use their mortgage provider and solicitor, they lie that they will unlikely to accept your offer. When I put in offer, they claimed the property has parking. They informed me after I paid for my mortgage broker fee etc that there's no parking.

2. All of the staffs disappeared for months - only contact you when they need you to pay something or there's a deadline or I'm really !!!!ed off. Never return your calls.

3. Mortgage service was horrible – after I paid the fee, I can hardly get in touch with the mortgage broker. You need to provide more things than going to a branch yourself!:mad: Also, the broker spelled my name wrong, TWICE on my contract - for god sake my full name has less than 10 characters!

5. Both vendor and I used in-house solicitors. Legal took 4.5 months and still imcomplete! My solicitor and I had been harrassed to proceed without complete legal process.

    The OP had better hope that this thread isn't seen by anyone who is prepared to issue proceedings for defamation, because there's plenty of ammunition provided for them.

    Just out of interest, why do you think the post is defamatory? Are you aware of some further information?

    To me, it sounds like a useful warning to FTBs reading the forum that property purchases can sometimes go wrong, and could leave you £3k out of pocket. And that the property buying process can be very frustrating.

    However, I agree that the OP could have used slightly more measured language.

    If the EA complains to MSE, I suspect the thread will be removed - because it's easier than arguing.

    The ideal solution would be if the EA posted their response, so that forum readers could judge for themselves.
