Rent application fee issue

  • Both of you remember paying the fee. If it came to court, that would be enough.

    Incidentally, you should not be paying any further fees: once your contract expires you automatically move on to a periodic tenancy unless there is a new contract, and that should be fine for you.

    So we paid initially for 6 months and then after 6 months we moved to a 12month contract where we could cancel anytime with a months notice
    So you say we should not pay another app fee??

    That's what we thought but you know what these pond scum are like with deposits

    We have a bank statement of me transferring 50% app fee to partner & her withdrawing that amount to pay to the guy at agency

    We've never paid rent late, had 2 perfect inspections, made the renewal app fee on time, etc
    So we paid initially for 6 months and then after 6 months we moved to a 12month contract where we could cancel anytime with a months notice

    So u have a contractual periodic tenancy. If u didn't pay any fees you'd have a statutory period tenancy where you can give notice on one month too.

    I presume though the ll cannot give u notice?

    After the first 6 months we signed a '12 month with break' contract which I believe means we can cancel anytime in the 12mth with a months notice & LL must give 3monthd

    So

    - if we renew, would be paying another app fee

    - should we have paid an app fee after the first 6 months at the start of the new 12 month contract or should we be having a refund


    As to the OP. if they've lost the first fee that's their issue & we've sent a strongly worded letter to them

    Ah slightly different. You have an ast with break clause. In which case yes fees are probably accurate.

    After 12 months is up u can go on statutory periodic, it's free, it happen automatically. Basically u can give 1 month notice, ll two. Basically the same as now

    Edit just to add ll cannot serve notice in first 6 months of your current contract, regardless of break clause

    We just wanted a rolling contract. Do we have grounds to get this second fee at the start of the 12mths back for misleading ?

    They have cheekily asked for another £100+ app fee

    Is that legal?!

    We won't be paying a penny more

    Ignore the original application fee. The LL was clearly satisfied that all fees/deposit/rent was paid or he would not
    a) have given you the keys or
    b) renewed the contract 6 months later

    Alos forget the 2nd fee that you paid - too late now to re-negotiate it!

    As for what you do now, you can sign a new tenancy agreement and pay whatever fee they request or you negotiate (yes, you can bargain them down), or you can save the fee and move to a SPT. See
