Which benefits?

A lady of pension age getting basic state pension, living and caring for her father in his house until his death, the house becomes hers in his will. She is living apart from her husband, he lives in the home owned jointly by them.

She does not want to go back to the husband, she wants to stay in the house willed to her. Is she entitled to any benefits?

Any advice welcome.

    blimey youve got me there. she may be entitled to claim second adult rebate on council tax provided her dad doesnt already claim HB and CTB.

    has she also tried to claim careres allowance?

    father has passed away and she is now living alone in the house willed to her ...... she is joint owner of marital home, aged 60 + ?

    if dad is still alive and claiming AA she could make a claim for carer's allowance but would not get it due to overlapping benefit rules but wuld become entitled to carer's premium, is husband working or pensioner? is there any occ pension, maybe pension credits are payable .... but maybe there are savings (hubby got any stashed )

    a lot of "ifs and buts" here, she needs to see someone asap and get everything sorted.

    Her father died and she is in the house on her own. But she also jointly owns the house where her husband lives, she does not want to live with him. I have just had a thought though, because she is married, the house she inherits, will also half belong to the husband she does not want:eek: . She is going to Citizens advice to sort it out:confused: .

  • AFAIK, if she is still married to the husband (even if living apart) any claim either of them make will be treated as a claim from a couple. So means-tested benefits will go on total income from both of them.

    Also if she is still married to him, I suppose he would be entitled to half the inherited house.

    She needs to take legal advice asap.

    (I'm sure someone will correct me if I am wrong in these matters).

    She can claim benefits in her own right as she is no longer living with her husband. However the DWP will more than likley expect her to take steps to realise her financial interest in the former marital home.
