Tesco - tablet broken after 13 months - partial refund

Hi,
I would like some advice on this issue please.
I purchased a tablet in store at Tesco at the end of December 2012, the value was just under a £100.
Unfortunately, now after 13 months it has broken.
Tesco electrical have offered a third of the value back - is this fair?
I'm a little bit miffed* but don't intend to let it ruin my life - should i just accept the offer of a partial refund?
*Will take my weekly shop of £70 elsewhere for a few weeks for that bit of personal satisfaction...(may even save me some money in doing so..a blessing in disguise perhaps.)
Thanks.

The law does allow them to offer a partial refund.CharliesDad wrote: »Hi,

Think about it... you have had 13 months use of it.
Maybe suggest a 50% refund would be more acceptable, but be aware that even after six months they are entitled to ask you to prove that the fault is inherent, so perhaps a no strings one third refund is ok.
You decide.
Edited to add:
What make of tablet?
Samsungs have a two year manufacturer's warranty, I think... maybe yours does?0 -
The law allows them to reduce the price based on the use you've already had out of the item. Unfortunately the law doesnt define how this should be calculated but generally there are two common ways used:
1) Pay the secondhand price for the item of the same age
2) Spread the cost out over its reasonable life expectancy and pay the residual, so if they say 3 years is the life and you've had it just over 1 year the refund would be just under 2/3rds
The problem with (2) is that it assumes a straight line depreciation where as some would argue there should be a curved with faster initial depreciation.
Personally, a 3rd is a bit low for my tastes unless they really think that life expectancy is only about 2 years0 -
What is the make and model of the tablet?
I notice in your first post you said "the value was just under £100", do you mean you paid just under £100 for it, or was the price less than that?
e.g. if it was in a half price sale for £50, you could argue that the value was £100, even though you only paid £50 for it.1. Have you tried to Google the answer?
2. If you were in the other person's shoes, how would you react?
3. Do you want a quick answer or better understanding?0 -

Well, if it was a model that had just been launched when you bought it, then it might be worth more than one which has been replaced a couple of times since then.
Also, check to see how much that model is selling for on eBay, e.g.

Negotiate a higher refund (if you can) and run away. Archos are notoriously low quality.
I remember paying nearly £200 for an MP3 player from them back in 2003.
It developed a fault (a common fault which also seems to be a common problem with Archos products) and after a lot of faffing around was sent back to them to repair. After getting it back it died again with the same issue. I just gave up.
I've looked at reviews from some of their recent products and long term it's the same story.0 -
I would try to negotiate a bit more.
What they are basically saying is that the lifespan of their tablet is about 18 months.35, semi retired, sun, sand, sea, life is good
When you are done moaning remember that there are people who would love to have your standard of living!0
