Hi,
I'm currently in disagreement with a mobile phone company regarding a contract, we thought we agreed to a 'rolling' monthly contract but they say we agreed to a 2 year fixed contract, this has now gone to the Ombudsman for investigation.
The company in question says that my credit rating will be affected if I don't pay-up, is this true? Also, if I loose will my rating be negatively affected and if so how badly?

Assuming that you were warned at some point that non payment could be reported to the CRAs, then yes they could default you or record late payments if they share payment history.
Saying that, also see paragraphs 42-45 of the ICO guidelines regarding reporting defaults where there is an unresolved dispute.

At worst a CCJ, a default at best I'm afraid.
