    It is very common for people to use additional borrowings, for essential items in the build up to an IVA.

    I do not necessarily agree that this will be seen as "fraud", if this was the case most people in an IVA would also have a conviction for fraud, which I can guarantee you they do not!

    I agree with UTMNII, if you need a washing machine consider getting one - if you were buying a new car for £10k as you would expect the creditor would be too impressed and may reject the IVA.

    It's certainly something that I investigated thoroughly in every bankruptcy case that landed on my desk! And yes if I found that activity I would be looking at it from a point of view of fraud in every case.


    Mind you it's not as bad as mum putting her and her daughter's cosmetic surgery bill on her credit card along with the full cost of the daughters pre paid wedding bill including the honeymoon and then declaring her self bankrupt 2 months later!!!

    I think in for a penny, in for a pound was the view taken.
