RBS ppi

Options
My other half has had an offer for payback of ppi on a loan, which he has accepted however the claim put in for the ppi on his mortgage has been rejected - all the info is the same i.e. Same bank, same workplace giving 12 months sickness & same scenario in that he didn't need or remember signing for any? Do we have a claim in stating to RBS why pay out on one but not the other when the circumstances are exactly the same!

Many thanks

Mortgage PPI is a different beast to loan PPI.

it wont be the same. Loan PPi covers an unsecured short term debt with limited consequences if goes unpaid. Sometimes the Loan PPI will not pay out if there are employer benefits. Mortgage PPI covers a long term debt secured against property with lifestyle changing consequences if it goes unpaid. it pays out in addition to employer benefits.

The FOS have been rejecting MPPI complaints where people have had 12 months sick pay on MPPI.

No. This argument is so totally transparent they won't take any notice of it. The "all my policies were sold in the same way" argument is a lazy load of nonsense usually used by people who want to jump on the compensation bandwagon but can't be bothered trying to put proper effort into it. Or in some cases are not even sure what policies they've had. I've seen people swear blind their credit card PPI was sold in the same way as their loan one when the loan was taken in branch and the card over the Internet!!!

He would have signed for the PPI on his loan as it appears on the agreement. But MPPI is impossible to have without signing for it, your bank has to have a signed direct debit instruction to release funds to the insurer, it appears on every monthly bank statement. He might not remember this but then again he probably wouldn't if it was a few years ago. How long ago was it? Have they sent you the paperwork with their rejection?

Yes copy of the page where he signed but he thought that was part of the mortgage itself! He's never had (or agreed to) ppi or insurance on anything & re the dd going out of the bank he thought they were buildings & contents insurance as listed at direct line! It was over 15 years ago we just need advice on where to go from here!

Forgetting about the insurance is not a mis-selling reason. It's a myth sponsored by Claims Companies that Banks routinely added PPI to loans, credit cards and mortgages without the knowledge or permission of the customer.
Look for valid mis-selling reasons if you want success.
