Hi
I was wondering if anyone could shed any lighto n this. An offer was accepted on share of freedhol property. However, after speaking to my solicitor they have informed me that i need to clarify exactly how it works ie who is responsible for repairs ertc. I have asked the EA for clarification and a second viewing and thye have got really shirlty with me. The EA turned round and said that if the seller gets a hint that i am going to pull out then she will put the proerty back on the market. The EA has said to me that its 50% share but i just wanted clarification on how things are worked out in terms of fences, if there is a leakage etc. I htink these are fair reasons etc.
I told the EA if i do not have clarification and a second viewing then i will delay the survfey to which he got really stroppy with me about. Has anyone else experince Spicer mcoll ea's I really now do not know what to do!
Any suggestions?

Your solicitor will investigate how it works officially as they have to otherwise the mortgage company won't allow it to proceed if the findings are unfavourable.
However most of the time the vendor tells the buyer this information informally before hand.
I suspect the EA doesn't know and is just bluffing. Some bluff by threatening people others just say your solicitor will have to find out as they don't know. Most EA's know SFA about the properties they are selling.
I would try and talk to the vendor even if the ea is present or one of the neighbours. Do a viewing in the evenings/weekend when it is likely someone is around, and turn up earlier and see if you can find a neighbour. (You will have to talk to the neighbours anyway if it's share of freehold.)
BTW you can do as many viewings as you like. I did 3 with different people at different times I know others who have done 5.I'm not cynical I'm realistic

Yes that is what they have said to me oh your solicotor should sort all of htat out! The EA just try to threaten me but it does not really work as i pointed out to them who exactly was buying the property. i have managed to get a viewining tonight which is good by myself so I will have no EA there at all. I actually am quite angry and have a good mind to speak to the seller and tell them exactly what the EA has bene saying to me....cause i am pretty certain she does not know! Its only two flats and hte other one has got tenants in it!
I suppose i need clarification on how the freehold works and who is responsible for what.....

If I where you I would give the seller my work/mobile phone number and try and get theirs. This means you can agree with them directly things like completion dates and what furniture/fixtures they are leaving.
Some sellers don't want to do this though.
If you can it may help stop the ea threatening you later down the line by saying if you don't complete by a certain date the seller is going to pull out. The ea does this cos they don't get paid a few months until after completion.
It happened to a friend of mine (the ea left loads of messages on their answer machine) so I agreed with my sellers when we were roughly completing so when the ea tried to push things he met a brick wall from both sides.I'm not cynical I'm realistic

Hi have i! Oh gosh i did not realise. IU have spoken to the vendors an dmet them again and the EA has been telling us both porkies! So from now on we are going to talk directly to each other. I have downloaded from the land registry website but not to sure if i have downloaded the righ thing.
