Hotel problems, but booked through an agent - Section 75??

    Maybe grovel to them asking them to reinstate the offer? Make it sound like you're doing them a favour by calling off your legals? Has to be worth a try.

    This just shows the dangers of DIY particularly when travelling to less than 'first world' destinations. With a package you would, on the face of it, had a valid claim against the operator here in the UK, potentially for both the injury and the illness and there are plenty of solicitors who would have been happy to help. Unfortunately if your contract is with the hotel (despite Hotels4U being owned by TC) and most 'bed banks' have terms that say they are responsible for nothing, then you really are 'up the Nile without a paddle' Sorry!

    The hotel was Aqua Blue Sharm.

    Er they booked through Thomas cook?

    So if the flights had been booked through them it wouldn't have made any difference as the issue is with the hotel.

    It's normally easier if you booked direct - no agent or third party agent to shuffle the blame about!

    Half the posts on this board are about problems with travel agents!

    Blindman, thank you for your kind comments, which happen to be wrong. I am not going to entertain a slanging match, you can watch Big Brother for that, but what I said was legally correct. You pays your money and takes your chance. It appears they booked the flights with Monarch and booked the accommodation through TC possibly on line. that is not a package and there is no responsibility on a travel agent in that situation, booking direct with the hotel would have had exactly the same outcome, its only if you book a package holiday that the organiser has a legal obligation to take responsibility for the faults of the suppliers
