Parking Fine this morning!

Hello, my first post on here as Ive been fortunate enough to have not received a parking ticket.

I received a ticket this morning for parking on private land. The land is at an entrance to a private car park which is underneath the building I live in. I have left my car here (and others including the buildings own maintenance men) many times and never received a fine. There are no yellow lines, or highlighted areas that have no parking zones. There is a sign for no parking, with lots of small print, not lit up at night time so easily missed. The rest of the parking around the building is also quite clearly marked with yellow lines as not to park. I have followed the advice from the website and written a rejection (not appeal) email this morning with the following:


To whom it may concern,

I am writing to reject the parking charge no xxxx for ‘No Parking’.

Firstly, I have no reference/idea of which company/council are making the charge on this ticket, only a request to send a payment by post to CPMS. Statutory Regulations require companies, sole traders and partnerships to make their identity clearly known on all business letters, invoices, receipts, demands for payments etc. Where a sole trader or partnership uses a business name, it is a statutory requirement that they display their name or the partners’ names in legible characters. Limited companies must clearly display their registered name, registered company number and registered address.
I am not going to send any money via post to an address, just because a ticket has been attached to my vehicle, which may be a scam. I could quite easily print this off and have people post money to my address. I also will not be sending you my address and contact details under this reasoning.

Secondly, I would like to enquire what 'No Parking' is in relation to? There is no suggestion that my car was on private land, as this is not marked out in any way.

Finally, my car was not parked on double yellow lines. My vehicle was not obstructing any entrances/roads and I feel was parked legally.

I have received the following reply from CPMS:

Thank you for your appeal received on 28/01/2014 regarding the above detailed Parking Charge Notice. We have

reviewed the case and considered the comments that you have made. This appeal has been considered in

conjunction with the evidence gathered by the parking attendant. Our records show that the notice was correctly

issued as your vehicle was parked in breach of the Terms and Conditions of Parking.

We are therefore unable to cancel the Parking Charge Notice as it was issued correctly. We have now extended

the discounted payment period by 7 days to allow you time to pay the discounted settlement amount. Please now

make payment of £60 to reach us by 11/02/2014 or £100 to reach us by 25/02/2014. We must advise you that

once the discounted settlement rate passes it will not be offered again.

Signage on this site clearly states that parking is not allowed in this area, your vehicle was in contravention of this

published restriction. This is an entrance to an underground car park and must be kept clear at all times. There

are signs clearly visible from where your vehicle was parked stating NO PARKING. This is to allow residents to

access the car park easily without the inconvenience of people parked by the doors.

It also says in the email that I cannot appeal again, which I know is wrong as I can appeal to POPLA, it even states that on their ticket.

How do I go about responding to this? Of course I do not wish to pay this fine so if someone could help point me in the right direction, I would greatly appreciate it!

    Have they not mentioned POPLA in the rejection? No form printed or attached on the back of the letter, no POPLA 10 digit number in the reply somewhere?

    If not then email back 'I think you have forgotten something - my POPLA code please or I will report you to the BPA and DVLA'.

    Then read 'How to win at POPLA' which is a hyperlink in the 'Private parking Ticket? Newbies read these FAQs first!' sticky thread at the top of the forum. You would LOSE at POPLA with an appeal written about what happened. You need the magic words.

    And what did their sign say, exact words? Do you have a photo of it?
    PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
