Parked slightly outside of the bay in a near empty car park :(

Good Afternoon,

Apologies if this has been raised before (I am sure it has :)). I did look over the templates to try and find an example.

I parked in the PPS car park in Exeter (along with about 4 other cars and I suspect it would hold 100 cars!). To be fair I was parked slightly outside there marked bay areas and this duly landed me with a £100 ticket even though I had gladly paid my parking fee of £2.

I emailed them saying OK it was slightly outside the bay but the car park was all but empty. I have received the full speel about my heinous crime.

Is this enforcable?

    Read the sticky thread 'Private Parking Ticket? Newbies please read these FAQs first!' for the next appeal stage and how to word it. Did they mention POPLA or IPC independent appeal stage?

    Read the sticky thread first though, all posts including 'How to win at POPLA'. We can't cover the same ground in every thread, hence the sticky at the top.

    Edit - hang on - you appealed and got a rejection letter. Did they include a POPLA code? You should NOT be waiting for anything, if no POPLA or IPC independent appeal form or code came with that rejection letter - check it thoroughly, front and back in case they 'hid' it - you will need to chase it and can complain to the BPA (if they are a BPA AOS member) or to the IPC (if they are an IPC AOS member).

    depends if you received a popla code or not, seeing as you outed yourself as the driver by emailing in response to the windscreen ticket instead of waiting for the ntk to arrive (act in haste , repent at leisure)

    so if it was a windscreen ticket, and you emailed as driver , and got a response, did you get any appeal code for the BPA or the IPC in their response ?
  • They have turned down my request via email and written to my place of work enclosing photos and a POPLA appeal form with a verification code. Looking at the appeal form it doesnt look of any use at all :(

    use the link in post #5 and then in that newbies thread post #3 has the links to popla appeals and templates , which you will now have to draft up in notepad and post on here for checking before submitting it in less than 28 days as it cannot arrive late

    if you read that link I gave you it said you should have waited for the NTK but in your haste you emailed them, outing yourself as driver and so they rejected your appeal and issued the 10 digit popla veification code for you to appeal to popla, circumventing all those other timings and not being able to appeal as keeper any longer

    so as you have already made several mistakes its important not to make another, so check your popla appeal code with the parking cowboys checker, then draft up your popla appeal for checking before submission
  • To be fair having a good scan through the appeals I can see nothing about parking slightly outside the given parking bay. They have photographic evidence but on what grounds do I appeal :)

    forget what happened , these are what you appeal on

    1) this charge is not a genuine pre-estimate of loss
    2) your signage does not comply with the BPA Code of Practice
    3) you do not have the authority or permission to issue invoices at this location

    plus the ticket was valid and paid for so include that too

    NOT on 'parking slightly outside the given parking bay'! You use the magic words you see in every appeal in the 'How to win at POPLA' hyperlink (in post #3 of the NEWBIES sticky thread). You could literally copy & paste any one of the examples there, and pretty much adapt it in 20 minutes and it would win.

    You are still thinking you have to makes excuses for YOUR actions when in fact a POPLA appeal is won on contract law (so it's about showing how the PPC have mucked the case up, how they don't own the land so have no legal standing, have shown no genuine pre-estimate of loss, and their signage was pants...etc.).
