Excel Car Park -Stockport parking charge notice

Have a parking charge notice dated 18 th January 2014 for Excel Car Park at the peel centre Stockport for £60

Never been to Stockport and was passing through on way to Manchester.. I was in the car park for about 30 mins.

It's an out of town centre and saw no obvious pay and display signs.
Done a lot of research on here and there seems to be lots of different info re this particular car park.some quite ambiguous.

Please can anyone tell me if the below statements I found on here are true?

1. Excel were suspended fro issuing parking charges from October 2013 to 15 jan 2014 .
2. Any tickets issued after 15 th jan are legal and you have to pay.
3. They lost a court case due to bad small sinage and have now changed the signs so you can not appeal on those grounds ?


Please can any one tell me how to appeal
I do not want to just ignore it and gets solicitors and debt letters threatening my clean credit record.

    No, you need to read the sticky thread 'Private parking ticket? Newbies read these FAQs first!' which mentions the Peel Centre in frustration a couple of times you will see. We don't need to cover old ground every day (not your fault, the fault of Excel at that car park). Point being this is covered ad infinitum on this forum and the sticky thread tells you what to do. So what if they changed their signs in July (you will still win at POPLA if you read the sticky thread). I think you've read some old threads so hope you were not planning on ignoring it when the advice is right here, to win at appeal in 2014.

    this car park features on here every day and has had at least 2 signage changes since the watchdog video and martin cutts court case

    it is definitely a pay and display car park and even googling it brings up the pictures of the signage

    it can only affect your credit rating if you got a CCJ and didnt pay it

    answer

    1) not to my knowledge although I know the machines had covers on them in early jan 2014 for some reason only known to excel , the earlier suspension was over 12 months ago

    2) no legality about it, but the pcn,s need to be paid or disputed, only a court case can decide if the pcn is legal or not, on an individual basis , subject to contracts etc

    3) you can certainly appeal on bad signage, doesnt mean you will win , but you can deffo appeal , as you can appeal on any grounds you like

    the most common 3 appeal points are in this typical soft appeal below
    Dear Excel,

    As the registered keeper of (reg) I'm in receipt of your parking invoice xxxxxx dated xxxxxx. I wish to invoke your appeals process as all liability to your company is denied on the following:

    1) this charge is not a genuine pre-estimate of loss
    2) your signage does not comply with the BPA Code of Practice
    3) you do not have the authority or permission to issue invoices at this location

    These points and others will be raised with Popla should you not accept this appeal, and you will be expected to provide a full breakdown of of your alleged loss, and your full unredacted contract with the landowner.

    If you do reject the challenge and insist upon taking the matter further I must inform you that I may claim my expenses from you. The expenses I may claim are not exhaustive but may include the cost of stamps, envelopes, travel expenses, legal fees, etc. By continuing to pursue me you agree to pay these costs when I prevail.

    Please issue your cancellation within 35 days of this letter or supply a popla code to appeal to them.

    Any communication that does not either confirm cancellation or include a POPLA verification code shall be reported to the BPA as a breach of their Code of Practice - the BPA recently issued guidance to all members to remind them of this fact. Such communication may also be deemed harassment and pursued accordingly.
