PCN charge ASDA Newquay

Just a quick message new to forums despite being a mse user for years. I got a PCN charge from Smart Parking back in july. I didnt receive first 2 charges as I had recently moved and post forwarding meant i didnt receive until the fine was then £80. Read on various sites to ignore which I have done but now up to about the 7th letter from Zenith and Debt recovery (I realise this is all the same firm). I contacted the branch stating i had made 2 shop one of which i paid on credit card one i paid cash annoyingly. They said happens quite often dont worry too much about it look on websites such as these. I overstayed the free parking by 8mins which is a bit harsh trying to shop etc with 2 children. I emailed andy clark CEO they said they are unable to cancel and to contact smartparking direct. They still have my incorrect details (my DVLA records were being updated the same time of PCN annoyingly). Is it likely they will take this further to court? I am almost more willing to risk this and pay court costs rather than make it easy for them after harassment they cause.

    might be worth trying to hook a popla code from smart too (you never know)

    you will keep receiving DR letters until they refer it back to client

    No, it is IMHO unlikely, as Smart don't 'do' Court.

    But you need to read the 'Private Parking ticket? Newbies read these FAQs first' sticky thread and read the separate post in it, all about debt collector stage (with special links about DRP and Zenith!). The sticky thread already spells out your options which include appealing anyway, and possibly naming the driver if it was a different person than the keeper so that they get sent a fresh Notice to appeal from scratch! Happy reading of the sticky thread first!

    Nope I don't/can't deal with cases by pm, sorry, no time. Cases like this are as straightforward as they get and Smart are not litigious, so post on your own thread but ONLY if the NEWBIES sticky thread doesn't answer all your questions. That's why I wrote it, to save us all from endless 'right, got a private PCN'...or 'right, got some Debt Recovery Plus letters that obviously no-one in the entire UK can ever have received before...now what do I do?' threads day in day out ad infinitum. We were nearly keeling over with frustration & boredom in the Summer and the sticky thread helps catch the first queries about PPCs. For me the most boring threads are about debt collector letters that already feature every day on the forum and in the stickies, and which we don't need to hear about ever again - and which the poster could simply have searched the forum for a keyword like 'Recovery' or 'Roxburghe' or 'Newlyn' or ''Rossendales' to answer their question in one minute flat. It's beyond me why newbies don't search first, very often!

    Anyway this isn't your thread, Jessii.

    should not be seeking personal help either , members like CM should not be bullied into providing personal help, you should pay a solicitor for that ! or get free help on here in your own threads
  • Thanks for help read everything and still not really sure where I stood.
    I went onto smartparking to appeal and it said that the PCN charge has been cancelled so all appears to be good news.
