Double Fine at By Euro Parking

Morning All,

Right here we go, bit of a newb here so be patient. I've read as much as i can on the forum, and slowly its blowing my mind with all the abbreviations what to do, change of law, ingnore or not.

So here's my story.

The wife was going to Morrisons to do the shopping, but had a funny feeling in her stomach about our unborn child so she decided to go to hospital which was only a short walk, i met her in the car park and left both our cars there whilst we went to the hospital to get checked out.

On our return we found the parking attendant placing tickets on both windscreens as we had over stayed our 2 hours, which really annoyed us and forced us to leave to car park without even doing our shopping.

Fine was issued on our Window Jan 18th, have until feb to pay £50 each. And it was in a Car park in Chester England, fine issued by Euro Parking

All i have gathered so far is to complain to manager of morrisons, but we dont have any reciepts, and then to wait for the 'Notice to Keeper'

is that correct?

    That is correct, I guess you mean Euro Car Parks? It's not a fine of course, but needs killing at POPLA as these are not 'genuine pre-estimates of loss' and good old ECP do not own the car parks they infest, so have no standing (as you will read in the example appeals in the NEWBIES thread).

    Wait for their NTKs then send a registered keeper challenge for each, not mentioning who was driving each car...leave it vague when it comes to it - you could write the same sort of letter, one from each keeper, saying: 'we' were at this site together and one of our party who was pregnant and shopping, had abdominal pains which caused the alleged overstay. We could not continue shopping and yet could not drive away until she felt better. The parking attendant saw her so he can verify the issue that delayed both cars from leaving that day. Our whole family are regular shoppers at Morrisons and have complained to them because harassment of a pregnant lady (seen by your attendant) is unlawful, and your charge doesn't represent any genuine pre-estimate of loss anyway. POPLA codes x 2 please, or confirm cancellation of both charges.'

    You don't 'have' to complain to Morrisons - depends how regular customers you are on other days though - you could perhaps prove regular recent patronage with a bank statement and explain to Morrisons CEO (by email) what happened on that day. He may get them both cancelled without any need to appeal after all.
