    The lease isn't easily accessible but apparently had no restrictions on parking originally but since then there have been meetings to change that and hand over to the parking company probably around six years ago. It would be documented in the minutes but he doesn't have then. If the Managing agents were asked to provide that I'm not sure they would be helpful in finding the right documents or in a timely manner

    We will attempt to get some information from the agent on the parking restrictions but if it is not forthcoming is the letter in the final stage with the removal of the text 'ticket machine etc' removed?

    When we appeal to POPLA - on what grounds? The four sections don't seem to relate:

    Vehicle improperly parked
    Parking charge exceed appropriate amount
    Vehicle stolen
    Not liable for the oarking charge (vehicle sold etc)

    Shouild I include any of the photos I posted here?

    All except Stolen apply. In reality it doesn't matter - the selectable options are pointless, but at least one must be selected. :)

    the problem was you did not wait for the NTK, but you have a popla code, so need to concentrate on winning at popla, as well as trying to get it cancelled by the landowner or landlord or managing agent

    I already gave you links to most of the info that needed to be sent

    as you have a popla code it has to be submitted by day 28 to popla, so not arriving late etc, you can check the code using the parking cowboys checker, but you dont have 28 days to submit it, you have 28 days from the date of the code to get it there , in other words it has to be with popla by the 28th day after the code date, not your date or my date or any other date, and certainly not late !

    so yes , post your draft appeal here for checking (copy and paste from notepad)

    Yep, read hash two, sorry messed up my keys so cant respond with the one's that don't work........scuze me. Still don't get your point? However, this thread has taught me how to have private land and live within the law, so thank you for that. I will endeavour to start my own thread on how to prevent people parking on my land. OP please excuse me for indulging and imposing on yours. Wonder what title I shall give my new thread? 'Land lies anyone parks'? 'Free to numpts'? 'I don't really have the financial means' to manage this, therefore, I must endure persistent parkers?? You decide?? Valid question I think??

    I have just been reading back through all the posts while we wait to see if we can get further info from the agents on the parking restrictions and I noticed in your post 26 the following comment
    Edit - and just seen again that the sign says 'failure to comply' which is
    great for you to argue 'the charge is not a genuine pre-estimate of loss' as
    your first point.
    do I need to change anything in the letter to emphasise that point?

    I presume the point being no loss of income as there is no charge for parking in that area therefore making a profit
