PPI claim on a statute barred account

Hi, I have an account that was staute barred last year. I decided to make a claim to get my ppi back. Can the company still take the money for the arrears on the account even though it's statute barred?

    Yes they can. The statute barring only applies to them being able to use the courts to reclaim the money. However, the debt still exists and lenders are allowed to use the PPI redress against arrears, defaults and amounts previously written off.

    You've escaped paying your debt and now you want a refund of your PPI as well?

    You can't have it both ways, I'm afraid.

    Thank you for your replies. I note on the letter it states that if I don't want them to take the award to pay the arrears I have to ring them?

    You can certainly ring them, but you'll need to be able to show good reason why they shouldn't offset any redress against your unpaid debt.

    Have you actually had your PPI complaint upheld?
