Capital One refusing PPI refund

I took out my CapOne credit card in 2005 and paid PPI premiums for a few years on that card until such time as I realised that you could have stand alone PPI cover for things like this at a fraction of the cost my credit card were charging so I cancelled it some two years later having set up my own policy. I was not sure that I had even asked for PPI to be in place at inception so I did the usual PPI template sent £10 and got a copy of my application and transactions to date having spent some £1,000 on PPI premiums! the PPI box had been ticked to say I wanted the cover BUT I did not sign the box to to confirm to proceed.... I went back to Cap One with my argument and they refused to budge. I reported them to FOS who came back to say that Cap One are refusing to look at my claim for return of premiums because they closed their file and I did not go to FOS within the six months time frame.
Had I ticked the boxed and signed (I was sure I hadnt asked for the cover and beleive it was assumed therefore by Cap One Iwanted the cover) i would have accepted their reply but my argument is that I did not sign the form to accept I wanted the cover and therefore not a valid agreement!
Where do I stand now if FOS cannot take it any further on my behalf? Any one know?

You dont report them to the FOS. Leaving aside the ticked box argument, I think that the fact that you purchased a standalone policy shows that you wanted cover. The fact that CAP one might have been more expensive makes no difference. You were always at liberty to take a standalone plan.0
