What happens after 365 days on Contribution based ESA

Ok for those of you who aren't familiar my previous threads I'm currently on contribution based ESA (WRAG). Now looking at my previous letters it appears my first interview was arranged for march 2013 so if the assessment phase is taken into account this would put me over the 365 days (if my calculations are correct)....so...

What happens after 365 days on contribution based ESA?

Will the DWP Notify me in advance if I am being transferred to Income based ESA?

As I stated in my previous thread I have several thousands pounds in savings so will this be taken into account? What happens if I am over the threshold?

Tia

I would not rely on them to transfer you automatically, with March as your anniversary i'd be ringing them now. They should send you a form (the name escapes me) to assess you eligibility for Income Related ESA.
    Savings do affect this.
If you are not eligible for IR ESA then you can keep your claim open for NI credits only, subject to passing the WCA of course.
  • my husband was in same situation got contribution based ESA for 365 days and received a letter saying it had stopped on 9th march last year and because we had savings and he had a pit pension couldn't claim anything else.

Which proves the point that putting a bit aside is sometimes never the right thing to do.

Anything over 6k capital will be taken into account on your claim for every £250 over 6k, £1 will be deducted. If you have over 16k you will not qualify and will receive Credits only.

Other factors also come into account, Partner's earnings for instance.

I'm not exactly sure of the rules for ESA but for Housing Benefit if your Capital is from a Personal Injury Compensation payment and it is in trust then it is fully disregarded.

    Hope this helps.

They should send you a form to claim Income Related ESA, when your contributory ESA expires. I think, but am not sure, it is called an ESA3 form.

Whether you get it or not depends on household income, savings etc.,

Should send a form but it's by no means guaranteed. This is why I always urge people not to rely on the DWP doing things correctly but initiate these things themselves.

You should be contacted before the contribution ESA ends but I wasn't! However as said income based is dependent on household income and savings so yu may not be eligible.

You can phone and ask for the form to claim.

Income-related ESA is also dependent on a partner's working hours, irrespective of how much is actually being earned.

Well, if he was working over x hours, subject to salary, I suppose he can claim Working Tax Credits anyway.
