You didn't ask for a breakdown of GPEOL or state that certain costs such as signage, wages, etc were not to be considered.

Hopefully that won't be a problem, but when the PPC comes back with their paperwork, bring the cots included that are invalid to POPLA's attention.
  • Dear all, had a rather lovely email land in my inbox.

    Success! :money:

Thank you to all the members who helped me with this appeal at its various stages. With a bit of time and effort, just goes to show these cases are eminently winnable. :T

Hope the documentation/case summary can help others in a similar position.

(Can a mod update the thread title to include 'case won' or equivalent or perhaps move to the success stories section?)

    Thanks again.

Another case where the PPC appears to have folded once a well-worded appeal was lodged. Is this a genuine result, in the sense that the PPC has agreed with the points raised, or is it just an example of a PPC running away from having to disclose the utter lack of basis to their charges?

We should keep in mind that Smart declared a 17% increase in "civil penalties" revenue in their 2013 trading year up to very nearly £4.3M - the only part of their business which saw an increase. This was despite the fact that their MD Paul Gillespie, who more than understands the UK parking situation, had to admit to shareholders that having DVLA access withdrawn in the early part of the year saw them lose £300,000 in "revenue".

Now forgive me Mr Gillespie but if all that your "civil penalties" are intended to do is return you to the situation you would have been in had there been no breaches of contracts how does this count as "revenue" and, more importantly, contribute to profitability?
My very sincere apologies for those hoping to request off-board assistance but I am now so inundated with requests that in order to do justice to those "already in the system" I am no longer accepting PM's and am unlikely to do so for the foreseeable future (August 2016). :(

For those seeking more detailed advice and guidance regarding small claims cases arising from private parking issues I recommend that you visit the Private Parking forum on PePiPoo.com
