UKPS Parking Ticket - Advice needed please

Last Sunday I received a ticket from UK Protection services for parking on private land. Now I was staying at my girlfriends flat and parked in the residents only car park for which we have a permit for, I always display the permit on my dashboard when I park there.


Now on this day it had slid off the dash onto the floor and someone has come along and given me a ticket for £100.


I wrote a letter to UKPS stating what had happened and provided them with a photocopy of the parking permit as well. I also told them that they could contact the relevant letting agents and housing association who would have it on their records that the particular car space was allocated to her flat and the car registration number as well.


Today they wrote a letter back rejecting my appeal on the grounds that there was no valid permit on display which is a breach of the contract.


They have also advised me that I can appeal further but as my appeal has been rejected on a point of law by their legal team they would advise me to pay the reduced £60.


A couple of years ago I received a ticket at Luton Airport and didn't reply back to Roxburgh and they left me alone but I am not sure what to do with this one now, can someone out there please advise me on my next step?

    You just go ahead and win at independent appeal stage! They have given you a code or form, yes?

    Well on a point of FACT we win 100% of the time at POPLA.

    Oh, IPC not POPLA, interesting. Right, have a look at 'How to win at POPLA' as I mentioned before, and draft an appeal from those examples. But post it here first and can you show us a picture of the sign on site?

    Finally how long do they say you have to appeal to IPC, only 14 days? We need to help you to win this but IPC is new and untested.

    Ah an IPC member so popla won't be involved. You need to appeal there I think, but do it as a letter and don't admit to driving, appeal as the registered keeper if possible.

    On a side note , the IPC says that each car park operator must prove genuine pre estimate of loss for each site, and they must approve it. Now in a permit parked place with no financial gain such as pay and display what will be the case here?

    And what would be the appeal, along the same lines as popla I guess ?

    Name, Address, PCN Number, Exact Date Of Incident, Date On Invoice, Reg Number, Vehicle Picture, The Time You Entered & Left Car Park, Or The Amount of Time You Overstayed.

    It says I have 14 days from date of letter to appeal it, (letter sated 23/01), also I don't know if this makes a difference or not but the car park is a gated car park with electric gates and you can only get into the car park with the fob, and not everyone has spaces.

    Also how can I post a picture on here? I thought I could take it and attach it somehow but can't figure it out.

    Finally I had a look at the How to win at POPLA pages but not sure how to write the appeal and on what?

    Shall I start a new thread and get some help on it as it's an IPC one?

    stick with this thread for a start, a new thread is not necessary

    photos can be put on photobucket or similar and a non-live link put in your reply post in here ( remove the http:// ) so we can go there and view it

    the IPC appeal system is untested and unknown, so you cannot expect members to know what to tell you as yet as you may be the first one, BUT that does not mean you dont use similar arguments than you would for a popla appeal , so you should still find similar popla appeals from post #3 of the NEWBIES thread and adapt one to your own circumstances

    the usual appeals are not a gpeol , no contract (no standing) , bad signage etc

    so pretend its a popla appeal but substitute IPC and try to adapt one for similar circumstances to those you found yourself in

    time is of the essence here seeing as you only have about 10 days for it to arrive

    Clearly states breach of contract but we need to see a pic of the sign on site if you can show it in a day or two please.

    Just draft an appeal based on copying a strong POPLA appeal from the How to win at POPLA link in the sticky thread, that seems to fit the bill (one that talks about 'no genuine pre-estimate of loss, but then against they all do!) then show your draft here along with the picture of the sign. You will need to show us the sign quickly as it does matter to the argument.
