Parking eye response HELP please

Hello, i apologise if the information I need is already on the forum but I cant seem to find what to do next.
I received a Parking eye charge standard letter with photos of offence that took place 24th December 2013. After reading advice on the forum I appealed online, outlining the main points as:
• Driver was a paying customer at XXX
• No genuine pre-estimate of loss
• Unclear/non-compliant signage
• No legal authority/contract
I also stated that if they rejected my appeal to send me a POPLA code, however I have received 2 separate letters back from them, one states the charge has been placed on hold for 14 days in order for me to provide more info and that I have stated that I was not the driver (I didnt state this in the appeal, I said "the driver was a paying customer")
The second letter is 7 pages of their justfication of pre-estimate of loss with example cases.
Neither letter contains a POPLA code or cancellation and im not sure where I go next.
Just for info I wasnt the driver but was in the car. It was Christmas Eve and we were taking my elderly mum last minute shopping. We were paying customers of the store and took a little longer than expected due to shop being very busy with last minute shoppers. We didnt even realise the car park was a 1.5 hour limit and we stayed 32 minutes over the stated time.
Any help on my next course of action would be greatly appreciated.

    they should have included the popla code, so write back saying CANCEL , OR POPLA CODE blah blah , reiterating you are RK and not outing the driver

    I'm guessing this is Aldi , have you complained there yet?
    When posting a parking issue on MSE do not reveal any information that may enable PPCs to identify you. They DO monitor the forum.
    We don't need the following to help you.
    Name, Address, PCN Number, Exact Date Of Incident, Date On Invoice, Reg Number, Vehicle Picture, The Time You Entered & Left Car Park, Or The Amount of Time You Overstayed.

  • I am also a little confused regarding a paragraph in one of the letters they sent which states:
    "parking eye is required to offer a 40% reduction to motorists for early payment within 14 days. therefore the reduced amount needs to be greater than or equal to £53 in order for parkingeye to run a successful business. Therefore the upper amount of the charge needed to be at the level outlined below. furthermore the amount of £100 was approved and prescribed by the BPA in 2012. therefore the full amount of the parking charge, which is an enforceable charge levied for breach of contract, is £100. The reduced amount for early payment is £60"
    However My PCN is £85 reduced to £50. Do they simply make up prices, I'm confused!

    Yes they make it up as they go along, there are some letters saying £55 also, so by the reckoning of parking eye they are losing between £3-£5 for each person paying early in this car park ;)

    The figures of course are garbage, it's been estimated that their true estimate of loss is about £15, some say as low as £7 for dealing with this. Their figures include costs for running their business, they cannot include that.

    An email to the BPA letting them know that PE are again procrastinating when it comes to pretending that drivers have to be named (the "more info" they refer to) and not giving popla codes.

    Yep - you will see that cited in POPLA appeal examples as showing 'no pre-estimate of loss'. See the NEWBIES read these FAQs first' sticky thread, post #3 'How to win at POPLA'

    Did you get a POPLA code or not yet? You must chase for it if not.
