PlayStation 4 Controller Wear

Hi everyone

Question for advice please.

I was fortunate enough to receive a PS4 from my family for Christmas. Lucky me!

Being a casual gamer, I like my technology and I am a loyal Sony person having owned all 3 previous consoles without any issues. However, only after 4 weeks of casual play, the rubber on the joystick analog stick is breaking away to the point it is now completely split and falling off.

A quick search on the net shows this is not an isolated problem. It looks like this is a widespread issue.

The question is, what are my rights under consumer law for a replacement of these pads? It seems they must be faulty to wear out so quickly. I have a ps3 and an xbox and neither of these have had an controller issues. They have certainly not lasted a reasonable amount of time by any stretch.

Thanks!

Jon

Well you personally probably have no rights because you didn't buy the console (unless the buyer got a gift receipt). The family member that bought it does have rights however. The Sale of Goods Act says that goods should last a reasonable time without being inherently faulty, and if they don't then the seller has to repair, replace or refund. The buyer can choose which remedy they prefer, by they can't force the seller into a remedy that is more expensive so technically the seller gets to pick.

As it is less than 6 months since purchase the fault will be assumed to be inherent unless the seller can prove otherwise.

Contact the seller of the ps4 and see what they say. They'll probably just replace the controller without any fuss.
