Default added to CRF 2.5 years after last payment

Greetings, I am new to this forum so would like the opportunity to say hi and thanks for reading this.

I have recently checked my credit file and I noticed that a debt I had with Welcome finance (Now being collected by MKDR, which I am in the process of having statute barred) has a default date of 1/1/10 and I know the last payment I made to them was at approx 1/6/07.

I read somewhere recently that the default should be issued within a reasonable amount of time after the payments cease. In the case I was reading they thought that 9 months was too long before they registered the default so got me wondering whether it is right that I will have to wait until 2016 for this to be removed as it was over 6 years ago when they could have defaulted me and that could have been 2 years or so earlier.

My questions are, can I contest the date of the default?

Can i then get it removed?

If so who do I need to contact to make that happen?

    Yes you can contest the default, you would need to write to whoever's name is on your credit file account entry to say that you think it is incorrect and unreasonable and not in accordance with the ICO guidelines on filing of defaults. You'd then state you believe the default should be no later than x and consequently the credit account entry and default should be removed from your credit file.

    If the debt is statute barred already then writing to them to correct the file shouldn't cause you any issues (if it was not quite statute barred you would be advised to wait until it was before contesting the default).

  • Thanks for your reply. I will wait for the confirmation of the debt being statute barred first and then contact them raising the points you mentioned. I did think the timing seemed a little unfair as it was having an 8 year impact and its nice to know they should amend it. I'm not expecting a quick outcome but it will hopefully be faster than 2 years.

  • You need to complain, in writing, to the company reporting the default. Once you are sure its SB.

    If they refuse or ignore you, after 8 weeks you can refer to FOS.
