Bank charges

I wrote to bank of Scotland yesterday and had a phone call from them just now to say that they only go back to 2009 and they have deemed the charges fair and will pop £40 into my account as a gesture of goodwill. Just going back 6 years there is over £1500 of charges which have resulted in a circle of charges and hardship that just goes round and round. Can I still contest this and where do I go now.

    The banks won the court case against unfair charges in 2009 so you can't contest these charges. If you had contacted them when the charges began they may have helped you but now it just looks to them as if you're jumping on the bandwagon of people trying to claim charges back.

    If you're still in financial hardship, contact them again but i would imagine they've already looked at your account in detail. To be in financial hardship means that you are unable to pay bills for essential living expenses. Things like Sky or cable tv, mobile phone contracts, eating out, gym memberships etc are classed as non essential so if you have anything like this going through your account, your request for any refunds will fail.

    You are reliant on the goodwill of the bank. If you can persuade the bank that you are CURRENTLY in financial hardship then they will look at your situation and decide on a solution. That can be suspending future charges and/or interest for a period or a part refund of charges or some debt management plan etc.

    If this was the bank's final decision, the bank should have informed you of where you can appeal; it's the FOS.

    If they didn't, you can complain about that too.
